Factors affecting the settlement amount of medical malpractice claims

보건정책 및 관리학과/석사[한글] 1981년 11월 1일부터 1995년 10월 31일까지 대한의학협회 공제회에 접수된2348건의 의료 분쟁 사례를 대상으로 의료 분쟁의 실태를 파악하고, 의료분쟁 해결시 합의액에 관련된 요인을 분석하였다. 합의액에 대한 분석에서는 법원에서 해결된 분쟁은 제외하였다. 전문 과목별 분쟁 접보건수는 산부인과가가 가장 많고, 다음으로 일반의, 일발외과, 정형외과, 내과의 순이었다. 의료 분쟁 처리 유형은 의료계내의 자체 해결이 1829건으로 82.8%이고, 경찰, 검찰 및 법원에서의 해결이 310건 14.1%였다. 연도별 건당 실평균 합의액이 건당 934만원, 연평균 상승율은 10.8%, 중위값은 589만원이었다. 전문 계열별 건당 실평균 합의액은 산부인과가 가장 높고, 다음으로 외과계, 내과계, 일반의의 순이었다 진료 유형별 의료 분쟁 발생은 수술 21.2%, 주사 19.2%, 치료 처치 17.9%, 분만 13.2%, 중절술 10.3%, 제왕절개 7.2%, 마취 2.5%였다. 실평균 합의액은 분만및 제왕절개와 관련된 경우가 가장 높고, 수술 및 마취, 기타, 주사 및 투약군의 순이었다. 의료 분쟁 처리 유형별 건당 실평균 합의액은 경찰 및 검찰을 통한 해결이 의료계내의 자체 해결이 보다 높았다. 사고의 결과 환자의 상태별 의료 분쟁 발생건수는 사망 37.8%, 합병증29.0%, 장애 12.3%, 기타가 20.9%였다. 환자나 태아가 사망했을 경우 실평균 합의액이 가장 높고, 다음으로 장애, 기타, 합병증의 순이었다. 사고 발생의 의사측 주장원인으로 불가항력 또는 잘못없다고 한 경우가 잘못을 인정한 경우보다 오히려 실평균 합의액이 높았다. 이는 불가항력 또는 잘못이 없다고 한 경우가 잘못을 인정한 경우보다 사망환자가 많고, 자체해결보다는 법원, 검찰 및 경찰에서의 해 결이 많았으며, 진료방해도 많았기 때문이다. 그러나 환자측의 주장원인인 의사의 관리 소홀이나 주의 부족에 의한 경우와 치료 처치상의 잘못이었다고 주장한 경우와 합의액에서는 차이가 없었다. 오진이나 과실이 없을 경우가 있을 경우보다, 의사의 수가 단독일 경우보다 2인 이상일 경우가 합의액이 높았다. 그러나 의사의 성별이나 의료사고의 경력은 영향이 없었다. 합의액에 영향을 미치는 요인으로는 진료 방해, 휴진이나 휴업 여부, 환자의 상태 및 처리 유형등이었다. 진료 방해가 있거나, 분쟁으로 인해 휴진 또는 휴업을 할 경우가 합의액이 많았다. 환자 상태가 합병증을 가진 경우에 비해 그렇지 않은 경우가 합의액이 적 은 경향이었으며, 장애나 사망의 경우는 그렇지 않은 경우 보다 많은 경향이었다. 진료의 유형에서는 주사나 투약등에 비해 수술과 마취, 분만이나 제왕절개등의 경우가 합의액이 증가하는 경향이었다. 분쟁의 처리유형에서는 의료계내의 자체 해결보다는 검찰 및 경찰에서의 합의액이 높은 경향이었다. 따라서 합의액 결정에 있어 의사의 오진이나 과실 유무, 적정 진료 유무와는 상관없이 환자의 사고후 상태나 분쟁의 처리 유형, 진료 방해등에 의해 합의액이 결정되므로, 합리적인 분쟁 해결 방식의 개선이 필요하다. 본 연구는 의협 공제회의 기록만을 분석하였다는 한계점이 있다. 앞으로 다른 자료를 보강하여 세부적인 비용구조의 분석이 이루어져야 한다. [영문] The purposes of this study are to investigate the characteristics of medical dispute and to analyze factors related to cost on resolution of medical dispute. 1 review 2348 cases reported to Korean Medical Association(KMA) Mutual-aid Association from Nov. 1. 1981 to Oct. 31. 1994. The rate of reported cases for obstetric-gynecology(OBGY) 31%, general practitioner 28%, general surgery 13%, orthopedics 7% and internal medicine 6.7%. 1,829 cases(83.2%) are settled out of court and without police's intervention. 300cases(13.7%) are settled by the police, the public precurator's office or the court. The mean settlement amount per case is 9,340,000 won with annual growth rate10.8%, and median settlement amount is 5,890,000 won. The mean settlement amount for OBGY is ,930,000 won, surgical group 8,900,000 won, medical group 7,710,000 won, general practitioner 7,490,000 won. The cases of medical dispute according to types of medical care are operation 21.2% injection 19.2%, treatment and care 17.9%, delivery 13.2%, artificial abortion 10.3%, cesarian section 7.2%, anesthesia 2.5%, respectively. The mean settlement amount according to types of medical care were delivery and cesarian section 15,190,000 won, operation and anesthesia 9,500,000 won, others 6,610,000 won, injection and medication 6,230,000 won, respectively. The mean settlement amount that out of court without police's intervention is 7,940,000 won, and in police's and public procurator's office and court is 17,290,000 won. The cases of medical dispute according to patient's status aree death 37.8%, complication 29.0%, disability 12.3% and others 20.9%. The mean settlement amount for death is 16,150,000 won, disability 9,430,000 won, others 4,850,000 won and complication 3,550,000 won. The mean settlement amount that doctors asserted that outcome is inevitable or have not agreed their fault is higher than cost of cases that they agree their fault. But the mean settlement amount in cases of between negliance in management that patients asserted and fault on care are not different. The mean settlement amount for misdiagnosis have not presented are higher than misdiagnosis have presented. And, the mean settlement amount for cases that multiple doctor have involved are higher than single doctor have involved. But there are no difference on mean settlement amount for doctor's sex and past malpractice history. Factors affecting the settlement amount of medical malpractice claimsaare disturbing practice, suspension of practice, patient's outcome, type of settlement. The mean settlement amount for disturbing practice and suspension of practice are high. The mean settlement amount for the complication is lower than others, and the mean settlement amount for disability and death presented are high. Concerning type of care, the mean settlement amount for operation/anesthesia, delivery/cesarian section are higher than injection/medication. Concerning type of settlement, the mean settlement amount in police's and public procurator's office is higher than in out of court without police's intervention. The mean settlement amount is rather decided by patient's status, type of settlement, disturbance of practice regardless of doctor's misdiagnosis, fault, standard care. Therefore, reasonable method of resolution on medical dispute is needed.
