An empirical study of the effect of making the special committee on budget and accounts in the national assembly operate year-round: Has the reform been effective?

국회는 예산심의가 보다 충실하게 이루어지고 행정부의 예산평성에 대한 국회의 통제를 강화하기 위해 2000년 5월 30일 예산결산특별위원회를 상설화 하였다. 그동안 예산결산특별위원회 상설화가 국회의 예산심의와 관련하여 기대효과를 나타낼 수 있을지에 대한 우려가 적지 않았다. 이 논문은 예산결산특별위원회 상설화가 기대효과를 발휘하고 있는지를 실증적으로 분석함으로써 이러한 의문에 답하고자 시도되었다. 재정년도를 기준으로 1979년부터 2007년까지 행정부가 제출한 예산에 대한 국회의 총 수정비율, 순 수정비율, 예산결산특별위원회 회의일 수 그리고 법정 예산확정일 지연일 수에 대한 회귀분석 결과에 따르면 총 수정비율, 순 수정비율, 법정예산확정일 지연일수는 예산결산특별위원회사설화에 의해 영향을 받지 않거나 오히려 기대와는 반대의 효과를 나타내는 것으로 나타났다. 반면, 예산결산특별위원회 회의일 수 증가한 것으로 추정되었다. 따라서 예산결산특별위원회 상설화는 아직 기대효과를 충분히 발휘하지 못하고 있는 것으로 결론지을 수 있다. May 30, 2000, the National Assembly passed a bill that makes the Special Committee on Budget and Accounts in the National Assembly operate year-round instead of only during a regular session. The reform was expected to make budget deliberation in the National Assembly more faithful and to strengthen the control of the budget by the National Assembly. All the while, there has been some question as to whether this reform has been effective or not. The purpose of this study is to answer the question through empirical analysis. The results suggest that the reform have had no effect or a negative effect on the gross revised rate of the budget, the net revised rate of the budget and the number of days overdue after the legal budget deadline. On the contrary, the number of the committee meeting days has been estimated to increase. This shows that the reform did not work out as expected

Empirical study on the lawmaking competency of public officer

급변하는 세계경제, 비약적인 기술 발전, 정부성과에 대한 기대의 증가는 공공서비스의 기술과 능력에 대한 새로운 관심을 요구하고 있다. 이러한 환경변화에 대응하고 정부의 생산성을 제고하기 위해서는 공무원의 역량을 신장시키는 것이 무엇보다도 중요하다는 인식이 확산되고 있다. 1970년대 후반 공무원의 능력과 기술을 명확히 하고 개선하기위해 미국에서 고안되어 1979년부터 미국 고위공무원단 (the U.S. Senior Executive Service)에 적용되었고 1990년대에 영국, 독일, 일본 등 선진국에 의해 도입된 역량 접근'(competency approach)은 바로 그러한 인식을 배경으로 한다. 우리나라도 역량 접근(competency approach)을 2006년 실시 예정인 고위공무원제도의 실효성을 제고하기 위해 고위공무원에게 적용하여 활용할 예정인 것으로 알려지고 있다. 공무원의 역량 중 특히 입법역량(law-making competency)은 법치행정의 규범과 실제 양면에서 필수불가결한 요소이다. 입법역량이란 정책을 입법적으로 구체화하는 과정에서 이루어지는 법령의 제정, 개정, 정비 등에 관련된 역량을 총칭한다. 우리나라의 경우, 행정부가 국회와 함께 법률안제출권을 공유해 왔고 행정국가의 전개 등 역사적인 이유에서 행정부가 입법 전문성 면에서 국회에 비해 상대적 우월성을 지니는 상황이 지속되어 왔다. 그러나 이와 같은 입법에서의 정부 주도경향, 그리고 정부입법 총괄기구인 법제처와 법제업무규정 등에 의한 법제업무의 중요성에 대한 관심에도 불구하고 공무원의 입법역량이 그에 상응하는 수준으로 확보되었는지는 대단히 의심스러운 실정이다 공무원의 입법역량 제고를 위한 정책적 노력을 촉구하는 목소리가 끊이지 않는 이유도 바로 거기에 있다. The ever changing global economy, dramatic technological changes, and increased expectations about government performance demand a new attention to public service skills and capacity. Based on the perception, the Competency Approach designed to clarify and improve the capabilities and skills of senior bureaucrats in the U.S. has been applied to the U.S. Senior Executive Service, introduced to the U.K. Germany and Japan in 1990's. In Korea, The Competency Approach is supposed to be applied to more than 3 upper-level public servants introducing Senior Executive Service in July, 2006. The competency of public officer , particularly law-making competency is a requisite to increase central or local government's productivity. Law-making competency is defined as the total competency related with making, reforming and putting in order administrative rules. This study, through the survey on the lawmaking competency of public officer in central and local government, measured their lawmaking competency and analyzed the factors to affect their lawmaking competency. The result of the analysis was that while personal factors such as majoring in law in undergraduate or graduate school, the period of the education related with legislative affairs or the number of dealing with legislative affairs are positively significant. Lawyer certification or Doctor of laws, total work period as a public officer and rank difference within middle-level government posts are insignificant. Among organization factors, the level of the organization's professionalism in regards to lawmaking and the interest in improving employee's lawmaking competency are both significant, the former positively and the latter negatively. The result of this analysis implies that the strengthening of education about lawmaking theories and skills and cultivating professionals in this field are both required to improve the lawmaking competency of public officer

A Study of Factors Causing Civil Inconvenience in Regulatory Administration.

규제개혁에 관한 기존 연구들은 실제 규제대상자들이 어떠한 요인으로 규제행정에 불만을 가지고, 정부의 규제가 강하다고 인식하게 되는지 그 원인을 종합적으로 분석하지 못하였다. 이에 본연구에서는 실제로 무엇이 규제행정에서 국민의 불편과 불만을 야기하는 지에 대하여 규제행정 민원인을 대상으로 파악하고자 하였다. 이론적 고찰을 통해 규제행정 불만 요인에 대한 분석틀을 도출하였으며, 이를 바탕으로 공무원과 규제행정 민원인을 대상으로 실증조사를 수행하였다. 국민 불만 요인을 크게 정책 요인, 집행주체 요인, 감독평가기관 요인, 정책대상자 요인, 환경요인으로 구분하여 살펴보았다. 분석 결과, 정책 내용 측면에서 규제의 중복성이나 상충성, 규제 절차의 복잡성, 규제로 인한 경제적 부담이 규제대상자의 불편을 야기하는 중요한 요소로 나타났다. 집행주체 면에서는 부처 이기주의가 존재한다는 점, 정부 부서 간 협조가 잘 이루어지지 않는다는 점, 공무원의 책임성이 낮다는 점, 공무원의 권위적 태도 등이 민원인의 중요한 불편 요인이었다. 그리고 공무원의 입장에서는 예산과 인력이 충분하지 않다는 점 등이 규제행정의 중요한 장애 요인으로 나타났다. 이밖에도 규제행정 개선에 있어 환경 요인이 전반적으로 중요한 것으로 나타났으며, 규제행정개선을 위한 권한의 충분성, 법규 적용의 정확성, 공무원의 태도 등에 대해서는 민원인과 공무원의 인식 차이가 크게 나타나 이들 간의 소통의 필요성이 제기되었다
