Study on Trustee's Compensation Liability for Breach of Trust in American Trust Laws

摘要 美国信托法对受托人的权利、义务和责任作了全面的规定。本文通过介绍美国信托法律(1959年《信托法重述》(第2版)、2005年《统一信托法典》及1994年《统一谨慎投资人法》)关于受托人违反信托义务的赔偿责任规定，对我国《信托法》中关于受托人的相关规定进行分析，并对完善我国信托法提出看法和建议。 除引言和结语之外，本文共由四部分构成： 第一章介绍了美国信托法关于受托人赔偿责任的定义，并通过相关法律规定及部分案例对赔偿责任产生的基础-信托义务的主要内容作详细的阐述。信托义务内容主要包括：依照信托文件处理信托事务的义务、谨慎义务、忠实义务、对信托财产分别管理的义务及亲自管理义务等。 第...ABSTRACT Trustee’s rights, duties and liabilities are comprehensively stipulated in American trust laws.
