Legal Relationship of Indirectly Held Securities Under QFII

我国的合格境外机构投资者(QFII)制度客观上确立了以QFII为证券中间人的跨境证券间接持有的法律关系。本文首先对QFII经纪业务的运作程序进行一般性分析,理清当中存在的几种法律关系;接着在国内实体法和国际冲突法层面对QFII进行法律分析,提出将我国的直接持有体系改造为间接持有体系的建议,并指出在国际社会层面制定统一实体法规范来明确间接持有证券法律关系中各当事人的权利义务要求将是QFII法律制度未来的发展方向。The legal relationship of indirectly held securities held with QFII as intermediaries has been established as a matter of fact under legal system of QFII in China .This paper gives a brief account of legal procedure under QFII brokery business in order to realize the legal relationship thereof .Then this paper makes a detailed legal analysis of QFII from the point of view of domestic substantive law and international conflicting law ,and addresses the suggestion that we should transform the directly held institution to the indirectly held institution ,and points out that there are the necessity and possibility for the international society to draw up harmonized substantive rules regarding indirectly held securities to facilitate the development of legal system of QFII

生物质粗燃气自热重整调变的热力学分析

运用吉布斯自由能最小化方法对生物质粗燃气自热重整过程进行了热力学分析，研究了重整反应过程中的温度，O2／CH4摩尔比及焦油摩尔分数等因素对平衡产物组成的影响规律。研究结果表明：低温有利于CO歧化与加氢反应，而高温促进了CH4和CO2的转化，提高合成气H2＋CO摩尔分数，降低H2／CO摩尔比。O2／CH4摩尔比的增加有利于生物质燃气从部分氧化反应向完全氧化反应转变，促进了CH4的重整反应而抑制了CO1的转化；O1／CH4摩尔比的增加降低了合成气H2＋CO摩尔分数，降低了H2／CO摩尔比，在重整后的生物质粗燃气中，n（H2）／n（CO）≈1。积碳量随温度升高和O2／CH4摩尔比的增加逐渐减少，随着焦油（C10H8）物质的量的增加而增加。焦油物质的量增加提高了合成气中H2与CO摩尔分数，是重整反应的重要原料。优化的生物质燃气自热重整反应条件为温度1023K，O2／CH4摩尔比0．7，焦油摩尔分数〈1％

Concentration and fractionation of phosphorous in soils with acidulated pig biochar

To determine the effect of addition of acidulated pig bio char on phosphorus (P) availability and fractionation in soils,an incubation experiment was carried out using a randomized complete block design having five treatments:an untreated control (ck),acidulated pig biochar,raw pig biochar,single superphosphate,and calcium magnesium phosphate,with three replications.Each amendment was mixed with soil at 0.1% (w/ w) and placed in a plastic pot.Soil samples were taken from each pot after a 210-day incubation period to assess P fractionation using modified Hedley's sequential extraction procedures.A correlation analysis was also included.Results showed that,compared to ck,electrical conductivity (EC) of the soil increased (P superphosphate > calcium magnesium phosphate > raw pig biochar.The percentage of stable P pools decreased (P<0.05) with addition of the amendments,and the proportion of the stable P pools was negatively correlated to the proportion of labile (R~2=0.86,P<0.01) and moderately labile (R~2=0.94,P<0.01) P pools.The acidulated pig biochar treatment significantly (P<0.05) increased the concentration of all P fractions and maintained a relatively low proportion of stable P in the treated soil.In conclusion,with significant differences in soil P concentrations and fractionations between acidulated pig biochar and chemical P fertilizers treatments tested,it would be potentially viable to use acidulated pig biochar as an alternative P fertilizer and substitute for superphosphate and calcium magnesium phosphate in agricultural production

查格勒布鲁剖面记录的OIS3a巴丹吉林沙漠季风气候变化

巴丹吉林沙漠东南缘查格勒布鲁剖面与OIS3a相同时代的CGS3a层段记录了5. 5个由沙丘砂或者黄土与湖相构成的沉积旋回。通过对该层段140个样品的Rb,Sr数据分析,结果显示由沙丘砂或黄土至上覆河湖相Rb、Sr含量相应的由低增高,而Rb /Sr的分布则显示出与Rb和Sr含量变化相反的趋势,Rb、Sr含量与平均粒径Mz( &phi;)的相关系数都达到了0. 8以上。研究表明CGS3a层段经历了5次冬季风和6次夏季风交替的气候波动,这些气候事件与GRIP冰芯氧同位素记录的D/O事件能一一对应,Heinrich事件也在其中有很好体现。CGS3a层段所记录的千年尺度气候波动既是对东亚季风环流演变历史的体现,同时也是对全球气候与环境变化的响应。</p
