    Divisiveness, National Narratives, and the Establishment Clause

    The Supreme Court habitually justifies the Establishment Clause as a means to prevent political division, protect the civil peace, and forestall citizen alienation. In spite of this popularity among the judiciary, legal scholars have emphatically rejected the political division theory. They state that religion is not especially divisive, and that even if it was, there is no reason to think non-establishment will prevent such political harm. This rejection relies on the misconception that the validity of the political division theory requires that all forms of religion must foment civil strife. This is a mistake. Often, laws apply to a wider category than to the core of what they seek to address. If this is the case, then even if non-establishment comes to merely prevent an especially erosive type of state and religion involvement, it may still be a valid and useful theory. In this Article, I argue that the political division theory is compelling when it is applied to a religion which seeks to collapse the distinction between politics and religion. To achieve this, I portray one such form of establishment of religion: American Christian Nationality, an ideology which sees the United States as having deep religious meaning and promotes Christianity as the central attribute of American identity. This Article will show that the combination between nationality and religion is uniquely divisive because it promotes a religious-based exclusionary understanding of who is a “real” American citizen. Many of the canonical Establishment Clause doctrines seem tailored to protect against government involvement in such religious movements

    Unions, Performance-Related Pay and Procedural Justice: the Case of Classroom Teachers

    Performance-related pay (PRP) and performance management (PM) are now a part of the organizationallandscape that unions face in the UK's public services. While PRP and PM threaten the scope of traditionalunion bargaining activities, they simultaneously offer a new role to unions as providers of 'procedural justiceservices' to both union members and employers. We explore the case of the introduction of these systems forclassroom teachers in England and Wales as a means of testing this idea. Our survey evidence shows thatclassroom teachers experiencing the introduction of PRP have expressed a strong demand for such services fromthe teachers' unions. Further, analysis of the PRP implementation process for classroom teachers indicates thatthe teachers' unions have progressively assumed a 'procedural justice role' since its introduction. Union actionin this regard has led to substantial modification over time of classroom teachers' PRP and PM. These changeshave addressed many of the concerns of teachers, have created a new institutional role for the relevant unions,and may permit the systems to avoid the operational difficulties they have experienced elsewhere in the UK'spublic services.Unions, Procedural Justice, Performance-Related Pay, Teachers

    Applying Task Force Recommendations on Integrating Science and Practice in Health Service Psychology Education

    The proper role of research skills and training to conduct research in professional psychology education has been controversial throughout the history of the field. An extensive effort was undertaken recently to address that issue and identify ways the field might move forward in a more unified manner. In 2015, the American Psychological Association (APA) Board of Educational Affairs convened a task force to address one of the recommendations made by the Health Service Psychology Education Collaborative in 2013. That recommendation stated that the education and training of health service psychologists (HSPs) include an integrative approach to science and practice that incorporates scientific-mindedness, training in research skills, and goes well beyond merely “consuming” research findings. The task force subsequently developed recommendations related to the centrality of science competencies for HSPs and how these competencies extend beyond training in evidence-based practice. This article discusses the findings of the task force and the implications of its recommendations for education and training in HSP. The challenges and opportunities associated with implementing these recommendations in HSP graduate programs are examined

    Although hypointellectuals have long been a part of our cultural landscape, it is in post-conflict societies, such as those in Bosnia and Kosovo, that there has arisen a strong need for a different breed of intellectual, one who is more than simply a social critic, an educator, a person of action, and a compassionate individual. Enter the non-partisan intellectual—the hyperintellectual. It is the hyperintellectual, whose non-partisanship is manifested through a reciprocating critique and defense of both the nationalist enterprise and strong interventionism of the International Community, who strives to create a climate of understanding and to enlarge the moral space so as to reduce the divisiveness between opposing parties. It is in this way that the hyperintellectual acts as a catalyst for the creation of a democratic culture within the civil societies of Bosnia and Kosovo
