Rol del juez de ejecución de penas y medidas de seguridad como garante del cumplimiento de las finalidades de la pena en Sincelejo - Sucre, durante los años 2015 - 2018 /

987 KB : 47 páginas ; ilustracionesLa Ley 590 de 2000 establece la figura del Juez de Ejecución de Pena y Medida de Seguridad y le asigna una importante tarea del ejercicio del Ius Puniendi del Estado, la vigilancia de la fase de cumplimiento de las penas o medidas de seguridad que son ordenadas por las sentencias dentro de un proceso penal. Con base en esto, su rol reviste gran importancia en la verificación del cumplimiento de las finalidades de la pena, en la búsqueda de mitigar la criminalidad y de lograr la reinserción social de los condenados; es por lo que éste es el principal objetivo de este trabajo. Para lograr la alcanzar el objetivo de esta investigación se revisaron, analizaron y recopilaron distintos trabajos de investigación, así como los cuerpos normativos de nuestro ordenamiento jurídico que regulan la materia, y, la jurisprudencia de las cortes colombianas. Primeramente se pasó a describir las funciones que se les han atribuido a las penas a lo largo de la historia, para posteriormente determinar las funciones del Juez de Ejecución de Penas y Medidas de Seguridad y su participación en el cumplimiento de los fines que la Ley 599 de 2000 reconoce a las penas en Colombia; de esta manera, con la articulación de estos tres puntos conseguir la explicación la importancia de esta figura. Por otra parte, el Establecimiento Penitenciario y Carcelario de Sincelejo – Sucre enfrenta uno de sus más grandes retos, la sede judicial solo cuenta con 2 jueces de ejecución de penas para la atención de los cientos de condenados que habitan este lugar, lo que aunado a los problemas de presupuesto y capital humano escaso de la rama judicial, convierte su labor en titánica y que precisa de análisis por parte de la academia para visualizar la problemática y reiterar la importancia de las funciones de estas figuras para el mejoramiento del sistema penitenciario en la región y el país. To achieve the objective of this investigation, various research papers were reviewed, analyzed and collected, as well as the regulatory bodies of our legal system that regulate the matter, and the jurisprudence of the courts Colombian.
