    Contemporary data infrastructures have had transformative effects; not only on methods, technologies and standards relating to data but also on our social, political, economic and cultural worlds. Building on the open data movement’s successes in the opening and sharing of data sets, Jonathan Gray argues it is time for a broader conversation around the making and development of data infrastructures. Until we institute processes to ensure data infrastructures reflect the concerns of their various publics, we risk sustaining systems that are disengaged from, or even damaging towards, those they are intended to benefit

    The dispensability of metaphor

    Many philosophers claim that metaphor is indispensable for various purposes. What I shall call the ‘Indispensability Thesis’ is the view that we use at least some metaphors to think, to express, to communicate, or to discover what cannot be thought, expressed, communicated, or discovered without metaphor. I argue in this paper that support for the Indispensability Thesis is based on several confusions. I criticize arguments presented by Stephen Yablo, Berys Gaut, Richard Boyd, and Elisabeth Camp for the Indispensability Thesis, and distinguish it from several plausible claims with which it is easily confused. Although I do not show that the thesis is false, I provide seven grounds for suspicion of our sense (if we have it) that some metaphors are indispensable for the purposes claimed by advocates of the Indispensability Thesis

    Phenomenally strong artworks have the potential to anchor us in reality and to cultivate our perception. For the most part, we barely notice the world around us, as we are too often elsewhere, texting, coordinating schedules, planning ahead, navigating what needs to be done. This is the level of our age that shapes the ways we encounter things and others. In such a world it is no wonder we no longer trust our senses. But as feminists have long argued, thinking grounded in embodied experience can be more open to difference; such embodied thinking helps us to resist the colonization of a singular, only seemingly neutral, perspective that closes down living potentialities

    Where Value Resides:Making Ecological Value Possible

    Distinguishing between the source and the locus of value enables environmental philosophers to consider not only what is of value, but also to try to develop a conception of valuation that is itself ecological. Such a conception must address difficulties caused by the original locational metaphors in which the distinction is framed. This is done by reassessing two frequently employed models of valuation, perception, and desire, and going on to show that a more adequate ecological understanding of valuation emerges when these models are fully contextualized in the intersecting life worlds of the ecological community. Ecological evaluation takes place in ongoing encounters between these worlds and a crucial part in this process is assigned to living beings that are “open-endedly open,” that is, open only to what the world affords them and others, but open to an indefinite field of possible valuational encounters between all kinds of beings. Ecological valuation overcomes some of the conceptual failings of contemporary attempts to evaluate nature: “The Economics of Ecology and Biodiversity” and “Valuing Nature.

    In today’s economy, consumers demand experiences. From Star Wars to Harry Potter, fans do not just want to watch or read about their favorite characters— they want to be them. They don the robes of Gryffindor, flick their wands, and drink the butterbeer. The owners of fantasy properties understand this, expanding their offerings from light sabers to the Galaxy’s Edge®, the new Disney Star Wars immersive theme park opening in 2019. Since Star Wars, Congress and the courts have abetted what is now a $262 billion-a-year industry in merchandising, fashioning “merchandising rights” appurtenant to copyrights and trademarks that give fantasy owners exclusive rights to supply our fantasy worlds with everything from goods to a good time. But are there any limits? Do merchandising rights extend to fan activity, from fantasy-themed birthday parties and summer camps to real world Quidditch leagues? This Article challenges the conventional account, arguing that as the economic value of fantasy merchandising increases in the emergent “experience economy,” intellectual property owners may prove less keen on tolerating uncompensated uses of their creations. In fact, from Amazon’s Kindle Worlds granting licenses for fan fiction, to crackdowns on sales of fan art sold on internet sites like Etsy, to algorithms taking down fan videos from YouTube, the holders of intellectual property in popular fantasies are seeking to create a world requiring licenses to make, do, and play. This Article turns to social and cultural theories of art as experience, learning by doing, tacit knowledge, and performance to demonstrate that fan activity, from discussion sites to live-action role-playing fosters learning, creativity, and sociability. Law must be attentive to the profound effects these laws have on human imagination and knowledge creation. I apply the insights of these theories to limit merchandising rights in imaginative play through fair use, the force in the legal galaxy intended to bring balance to intellectual property law
