    The role of patent protection in (clean/green) technology transfer.

    Global climate change mitigation will require the development and diffusion of a large number and variety of new technologies. How will patent protection affect this process? In this paper we first review the evidence on the role of patents for innovation and international technology transfer in general. The literature suggests that patent protection in a host country encourages technology transfer to that country but that its impact on innovation and development is much more ambiguous. We then discuss the implications of these findings and other technology-specific evidence for the diffusion of climate change-related technologies. We conclude that the “double externality” problem, that is the presence of both environmental and knowledge externalities, implies that IP may not be the ideal and cannot be the only policy instrument to encourage innovation in this area and that the range and variety of green technologies as well as the need for local adaptation of technologies means that patent protection may be neither available nor useful in some settings.Climate change; intellectual property; innovation; technology transfer

    MNCs’ Ownership Advantage, Developing Countries, And New Regionalism

    Since the mid-1980s, more regional trade arrangements (RTAs) have arisen between developing and developed countries than before. The evidence shows that MNCs are the major driving force of the new regionalism. The puzzle presented in this paper is why MNCs would like to propel new RTAs between developing and developed countries. The paper believes that the emergence and development of new regionalism is, to a great extent, related to the situation that MNCs wish to enter into developing countries markets. However, it is not easy for MNCs to access to this developing market. MNCs still have to be faced with challenges brought about by both their more and more public-good-like ownership advantages and the increasing cost of producing ownership advantages. If MNCs did not extend their market to the developing countries, they would not spread the cost of producing ownership advantages. However, if they did, they would face the risk that their property of public goods is freely ridden by developing countries due to no effective intellectual property protection (IPP). Therefore, MNCs have to produce much demand for building up new RTAs including developing countries to protect their ownership advantages, especially when they meet the difficulties in multinational negotiation in IPP.Regional Trade Agreements, Multi-National Corporations, East Asia

    Going Global: The Challenges for Knowledge-based Economies

    The present volume aims to provide a comprehensive and systemic overview of the challenges that going global poses to knowledge based economies. Its focus is four-fold. 1) Firstly, it investigates why companies, especially high-tech firms, go global, i.e. which are the drivers that push companies to locate – R&D facilities in particular – elsewhere than in the home country. The analysis of the competitive advantages that enterprises seek in the host countries also includes the new techno-economic geography that emerges. Attention is devoted to the time frame of these phenomena and to features such as the development stage of the home and host country, the characteristics of both firms and industries, and the Product Life Cycle of the latter. 2) Secondly, it analyses the impact that the various corporate relocation phenomena might have on intellectual capital, innovative output and the labour market, and growth and development. (Re)locating in fact impacts on knowledge creation, exploitation – including the use of IPRs – , absorption, circulation and spillovers. In turn, these play a fundamental role in shaping the productivity, competitiveness, and ultimately growth and development of both enterprises and countries. 3) Thirdly, it addresses the questions of if and to what extent the current and prospective global dynamics call for new types of governance. Such a need arises if different policy domains have to converge towards common strategic welfare enhancing objectives. Attention is also devoted to the various policies put in place by small open economies that ‘go global’, such as Finland. 4) Fourthly, it addresses the sustainability aspects of going global by investigating how to better share the social, economical and ecological benefits and responsibilities arising from globalisation, technological change, and innovation.     Koyaanisqatsi is a Hopi Indian word that translates into English as 'life out of balance,' 'crazy life,' 'life in turmoil,' 'life disintegrating,' all meanings consistent with indicating 'a way of life which calls for another way of living.” While not wishing to suggest either that the international regime of intellectual property rights protection scientific and technical data and information is “crazy” or that it is “in turmoil”, this paper argues that the persisting drift of institutional change towards towards a stronger, more extensive and globally harmonized system of intellectual property protections during the past two decades has dangerously altered the balance between private rights and the public domain in data and information. In this regard we have embarked upon “a way of life which calls for another way of living.” High access charges imposed by holders of monopoly rights in intellectual property have overall consequences for the conduct of science that are particularly damaging to programs of exploratory research which are recognized to be critical for the sustained growth of knowledge-driven economies. Lack of restraint in privatizing the public domain in data and information has effects similar to those of non- cooperative behaviors among researchers in regard to the sharing of access to raw data-steams and information, or the systematic under- provision the documentation and annotation required to create reliably accurate and up-to-date public database resources. Both can significantly degrade the effectiveness of the research system as a whole. The urgency of working towards a restoration of proper balance between private property rights and the public domain in data and information arises from considerations beyond the need to protect the public knowledge commons upon which the vitality of open science depends. Policy-makers who seek to configure the institutional infrastructure to better accommodate emerging commercial opportunities of the information-intensive “new economy” – in the developed and developing countries alike –therefore have a common interest in reducing the impediments to the future commercial exploitation of peer-to-peer networking technologies which are likely to be posed by ever-more stringent enforcement of intellectual property rights.

    Commercial High Technology Innovations Face Uncertain Future Amid Emerging BRICS Compulsory Licensing and IT Interoperability Frameworks

    The pathways that lead to the success of cutting-edge technologies are often fraught with risk, difficulty, and uncertainty. These issues are particularly prevalent under a regime involving lengthy time horizons for competent research, development, and commercialization, which may require regulatory approvals. These challenges are known to be endemic to capital-intensive technology development which requires significant follow-on funding, particularly in highly regulated industries such as life sciences (e.g., pharmaceuticals/biotechnology and electronic medical devices ) and clean technology (which may be subdivided into clean or renewable energy generation and clean or renewable energy efficiency technologies and services, the former having more direct exposure to the regulatory environment ). Such conditions also pose considerable obstacles to the development and introduction of new paradigm-setting information and communication technologies (ICTs) categorized by reference to the economic activities generated by their application to and use within other industry sectors, including healthcare, energy and the environment, transportation, information and education, emergency and disaster management, and defense and national security. According to one recent study, the ICT sector undertakes large investments in R&D and is very innovative. In terms of R&D expenditures, patents, and venture capital investment, it exceeds other industries by a large margin

    Toward a process theory of entrepreneurship: revisiting opportunity identification and entrepreneurial actions

    This dissertation studies the early development of new ventures and small business and the entrepreneurship process from initial ideas to viable ventures. I unpack the micro-foundations of entrepreneurial actions and new ventures’ investor communications through quality signals to finance their growth path. This dissertation includes two qualitative papers and one quantitative study. The qualitative papers employ an inductive multiple-case approach and include seven medical equipment manufacturers (new ventures) in a nascent market context (the mobile health industry) across six U.S. states and a secondary data analysis to understand the emergence of opportunities and the early development of new ventures. The quantitative research chapter includes 770 IPOs in the manufacturing industries in the U.S. and investigates the legitimation strategies of young ventures to gain resources from targeted resource-holders.Open Acces
