    This article is structured as follows. Part I considers the reasons why cases do not settle, or why they do not settle more quickly than they do, and discusses how settlement escrows can facilitate settlement in each context. Part II provides a game-theoretic model of a settlement escrow in order to further demonstrate how this device can reduce delay and promote settlement in the presence of asymmetric information. In the model, the use of an escrow device results in a higher level of settlement than would occur in the absence of the escrow, and thus saves transactions costs for the parties. In addition, the expected settlement is as close or closer to the true value of the claim than in the absence of a settlement escrow. Part III discusses some subtle issues and potential problems with the implementation of settlement escrows. Part IV briefly suggests some potential applications of the model outside the context of civil litigation and Part V addresses the relationships among arbitration, mediation, and settlement escrows

    The concept of special escrow accounts to improve mortgage housing loans in Russia

    Purpose: The article aims to identify and evaluate the key determinants of improving mortgage lending in Russia. Increasing the participation of financial institutions in the application of escrow accounts is of paramount importance in terms of fine-tuning the process of improving mortgage lending in Russia. Design/Methodology/Approach: In order to further improve housing mortgage lending, it seems necessary: firstly, to identify new opportunities that contribute to the development of a system of interaction between credit and financial organizations and borrowers in terms of using the innovative functions of escrow accounts; secondly, to highlight the functions, during the application of which the increase in the efficiency of the escrow account mechanism will be optimal; thirdly, to formulate recommendations on the implementation of the necessary changes in the process of applying escrow accounts, taking into account the peculiarities of mortgage lending in Russia. Findings: To fully take into account the potential impact of special escrow accounts on the process of interaction between the lender and the borrower, an additional escrow account functionality was developed, aimed at improving mortgage lending. Practical Implications: The results of the study can be put into practice in order to expand the range of escrow account functions used in the process of mortgage lending in Russia. Originality/Value: The main contribution of this study is the emphasis on the need to introduce innovative approaches to increase the functionality of escrow accounts used in the process of mortgage lending in Russia.peer-reviewe

    TumbleBit: an untrusted Bitcoin-compatible anonymous payment hub

    This paper presents TumbleBit, a new unidirectional unlinkable payment hub that is fully compatible with today s Bitcoin protocol. TumbleBit allows parties to make fast, anonymous, off-blockchain payments through an untrusted intermediary called the Tumbler. TumbleBits anonymity properties are similar to classic Chaumian eCash: no one, not even the Tumbler, can link a payment from its payer to its payee. Every payment made via TumbleBit is backed by bitcoins, and comes with a guarantee that Tumbler can neither violate anonymity, nor steal bitcoins, nor print money by issuing payments to itself. We prove the security of TumbleBit using the real/ideal world paradigm and the random oracle model. Security follows from the standard RSA assumption and ECDSA unforgeability. Corp., a Delaware Bankruptcy Court applied New York law to both equitable and legal arguments made by the debtor, holding that funds in an escrow account created by the debtor were not property of the debtor’s estate. 369 B.R. 156, 164–65 (Bankr. D. Del. 2007). First, this memo will examine the two opposing legal and equitable arguments made by the parties, with each relying on different theories of characterizing the debtor’s interest in escrow accounts as they have evolved throughout New York caselaw. Second, it will analyze the contingency argument made by the department, which primarily relied upon law from a similar case in another jurisdiction. Third, it will discuss decision made by the Delaware Bankruptcy Court, including the reasoning adopted by the Court. Finally, it will conclude by alluding to the broader implications of this case, as it could provide guidance for the future of New York law in this area as well as providing practical advice on how to protect the interests of those developers who rely on the use of escrow in real estate transactions on a regular basis

    A field study of real estate agents\u27 transactions demonstrates that business friendship affects the negotiation process and the outcome of transactions more for agents with 10 or more years of experience in real estate brokerage than for less experienced agents. Newer agents rely more on friendly relations and on impression management techniques to do well in a transaction, while the more experienced agents consider genuine business friendship and its norms useful for facilitating transactions. Different scripts for friendship may explain the consistency within each of the two groups
