    In modern trademark law the process of registering a valid trademark is straightforward. In the United States the Lanham Act is the ruling law of trademark law. The Lanham Act grants protection to the owner of a registered mark which is distinctive and used in commerce. Assuming all the requirements are met, the owner of a mark can use the mark within its discretion and enjoy the protection under the Lanham Act. As trademark law has continued to evolve, the law has expanded to protect previously unforeseen categories. The two most obvious examples which demonstrate the evolution of protection under trademark law are trade dress and antidilution protection. These two areas demonstrate trademark law’s ability to evolve to address areas not recognized through established law. Nowhere is an adaptation of trademark law required more than in user-created avatars. The emergence of user-created content has begun to become a common occurrence within the areas of electronic media. Video games can currently give players a blank slate upon which they can build their own creation. Issues however arise when there are inquiries into who legitimately owns theses creations and what protections they are afforded

    Impact of remote sensing upon the planning, management, and development of water resources

    Principal water resources users were surveyed to determine the impact of remote data streams on hydrologic computer models. Analysis of responses demonstrated that: most water resources effort suitable to remote sensing inputs is conducted through federal agencies or through federally stimulated research; and, most hydrologic models suitable to remote sensing data are federally developed. Computer usage by major water resources users was analyzed to determine the trends of usage and costs for the principal hydrologic users/models. The laws and empirical relationships governing the growth of the data processing loads were described and applied to project the future data loads. Data loads for ERTS CCT image processing were computed and projected through the 1985 era

    Interactions among telecommunications networks, computers, and other peripheral devices have been of interest since the earliest distributed computing systems. A key architectural question is the location (and nature) of programmability. One perspective, that examined in this paper, is that network elements should be as programmable as possible, in order to build the most flexible distributed computing systems. This paper presents my personal view of the history of programmable networking over the last two decades, and in the spirit of vox audita perit, littera scripta manet , includes an account of how what is now called Active Networking came into being. It demonstrates the deep roots Active Networking has in the programming languages, networking and operating systems communities, and shows how interdisciplinary approaches can have impacts greater than the sums of their parts. Lessons are drawn both from the broader research agenda, and the specific goals pursued in the SwitchWare project. I close by speculating on possible futures for Active Networking

    A rapid prototyping/artificial intelligence approach to space station-era information management and access

    Applications of rapid prototyping and Artificial Intelligence techniques to problems associated with Space Station-era information management systems are described. In particular, the work is centered on issues related to: (1) intelligent man-machine interfaces applied to scientific data user support, and (2) the requirement that intelligent information management systems (IIMS) be able to efficiently process metadata updates concerning types of data handled. The advanced IIMS represents functional capabilities driven almost entirely by the needs of potential users. Space Station-era scientific data projected to be generated is likely to be significantly greater than data currently processed and analyzed. Information about scientific data must be presented clearly, concisely, and with support features to allow users at all levels of expertise efficient and cost-effective data access. Additionally, mechanisms for allowing more efficient IIMS metadata update processes must be addressed. The work reported covers the following IIMS design aspects: IIMS data and metadata modeling, including the automatic updating of IIMS-contained metadata, IIMS user-system interface considerations, including significant problems associated with remote access, user profiles, and on-line tutorial capabilities, and development of an IIMS query and browse facility, including the capability to deal with spatial information. A working prototype has been developed and is being enhanced
