QUANDO O ESTADO DECIDE QUEM PODE SABER:: SIGILO, DIREITOS DAS VÍTIMAS E NECROPOLÍTICA NO CASO MARIELLE FRANCO

Abstract

The assassination of Marielle Franco represented not only a political attack but also a symptom of the necropolitical structures that permeate the Brazilian state. This study investigates the limits imposed on the participation of victims and their families in investigations into serious human rights violations involving state agents, with a focus on the secrecy of police inquiries and the role of private prosecution (assistência à acusação). The analysis centers on the decision of the Superior Court of Justice in Writ of Mandamus No. 70.411/RJ, filed by Mônica Benício, Marielle Franco’s partner, seeking access to the investigation into those who ordered the crime. The research adopts a critical approach, grounded in documentary analysis and literature review. It concludes that restrictions on access to investigations and on victims’ participation at this stage reveal a pattern of institutional selectivity in which victims’ rights are conditioned by social markers such as race, gender, and class.O assassinato de Marielle Franco representou não apenas um ataque político, mas também um sintoma das estruturas necropolíticas que atravessam o Estado brasileiro. Este trabalho investiga os limites impostos à participação das vítimas e seus familiares em investigações sobre graves violações de direitos humanos em casos com o envolvimento de agentes estatais, com foco no sigilo do inquérito policial e na atuação da assistência à acusação. A análise se concentra na decisão do Superior Tribunal de Justiça no Recurso em Mandado de Segurança n.º 70.411/RJ, interposto por Mônica Benício, companheira de Marielle Franco, a fim de garantir acesso ao inquérito que apura os mandantes do crime. A pesquisa parte de uma abordagem crítica, fundamentando-se em análise documental e revisão bibliográfica. Conclui-se que a restrição ao acesso à investigação e à participação das vítimas nessa fase revelam um padrão de seletividade institucional, no qual o direito das vítimas é condicionado por marcadores sociais como raça, gênero e classe
