Separación de Poderes y Restricción de Derechos Políticos: La Reconfiguración del Poder Disciplinario Colombiano Posterior a la Ley 2094 de 2021 En Base A Las Sentencias C-030 de 2023 y SU-381 de 2024

Abstract

La Ley 2094 de 2021 dio la reforma del poder disciplinario en el país, en respuesta al estándar fijado en el caso Petro vs. Colombia C.I.D.H sobre la restricción de derechos políticos. Esta reforma creo una discusión constitucional de separación de poderes y la esencia del ius puniendi disciplinario. El artículo analiza la interpretación de la corte de cierre posterior a la reforma, en providencias C-030 de 2023 y SU-381 de 2024. A partir de un enfoque dogmático y la construcción de una línea jurisprudencial, que no debilitó la potestad disciplinaria de la Procuraduría, sino que alineó un modelo híbrido institucional, que articula la facultad del poder disciplinario con un control judicial, para la reserva de derechos políticos, garantizando el artículo 23 de la C.A.D.H y la estructura tripartía del Estado.Universidad Libre Seccional Socorro -- Facultad de derecho, ciencias políticas y sociales -- Maestría en derecho administrativoLaw 2094 of 2021 reformed disciplinary power in the country, in response to the standard set in the Petro v.
