Abstract

The article aims to analyze, based on the powers defined by the Federal Constitution, whether it is within the jurisdiction of the Courts of Accounts to participate in the execution of civil non-prosecution agreements (ANPC) entered into by the Public Prosecutor's Office in cases of administrative misconduct. In this regard, it examines the (un)constitutionality of art. 17-B, §3, of Law No. 8.429/1992, included by Law No. 14.230/2021, which assigns to the Courts of Accounts the duty to participate in determining the amount to be reimbursed under a civil non-prosecution agreement. Initially, the nature and legal foundations of the ANPC are examined. Next, the analysis focuses on the powers of the Courts of Accounts. Subsequently, in light of the independence between the instances, it is investigated whether the Courts of Accounts should, in any way, influence the execution of ANPC. The article aims to offer a critical reflection on the role of the Courts of Accounts in the context of ANPC.O artigo busca analisar, com base nas atribuições definidas pela Constituição Federal, se compete aos Tribunais de Contas participar da celebração de acordos de não persecução civil (ANPC), firmados pelo Ministério Público, diante de atos de improbidade administrativa. Nesse sentido, averígua-se a (in)constitucionalidade do art. 17-B, §3º, da Lei nº 8.429/1992, incluído pela Lei nº 14.230/2021, que atribui ao Tribunal de Contas o dever de participar da apuração do valor a ser ressarcido em sede de acordo de não persecução civil. Examina-se, em um primeiro momento, a natureza e os fundamentos legais do ANPC. Em seguida, a análise é voltada às competências dos Tribunais de Contas. Na sequência, verifica-se, à luz da independência entre as instâncias, se caberia aos Tribunais de Contas influírem, de alguma maneira, na celebração dos ANPC. Busca-se oferecer uma reflexão crítica sobre o papel dos Tribunais de Contas no contexto dos ANPC
