Las iglesias locales como escenario de juramentos judiciales en el noroeste de la península ibérica altomedieval

Abstract

In the early medieval charters from the northwest of the Iberian Peninsula, churches sometimes appear in judicial contexts as the setting of oaths. This article discusses the criteria that may have guided the choice of church in each case. To this end, the available records for the regions of León and Castile prior to 1100 are analyzed, considering the nature and dynamics of the judicial processes and the functions of the oath within them, the social status of the disputants, the rank and composition of the judicial assemblies, and the social and political landscape of which the churches that hosted the oath were part. It concludes that, in choosing the churches, judicial authorities may have acted strategically, since the choice could condition the development of the judicial process and influence the public image of both the disputants and the judicial authorities themselves.En la documentación altomedieval del noroeste de la península ibérica, las iglesias aparecen en ocasiones en contextos judiciales como escenario de juramentos. Este artículo discute los criterios que pudieron guiar la elección de la iglesia en cada caso. Para ello, se analizan los registros disponibles para las regiones de León y Castilla con anterioridad al año 1100, considerando la naturaleza y la dinámica de los procesos judiciales y las funciones del juramento en el seno de los mismos, la condición social de las partes en conflicto, el rango y la composición de las asambleas judiciales y el paisaje social y político en el que se integraba la iglesia que habría de albergar el juramento. Se concluye que la elección del lugar del juramento podía tenía un carácter estratégico, toda vez que con ello se podía condicionar el desarrollo del proceso judicial e influir en la imagen pública de las partes en conflicto y de los propios actores judiciales
