ARGUIÇÃO DE DESCUMPRIMENTO DE PRECEITO FUNDAMENTAL 188 E A FUNÇÃO REDISTRIBUTIVA DA UNIÃO

Abstract

This article analyzes the impact of the Supreme Federal Court\u27s decision in the case of the Fundamental Precept Violation Claim 188, which altered the methodology for distributing resources from the Salário-Educação, one of the main mechanisms for funding basic education in Brazil. Through a legal analysis and projected data for 2024, the article investigates how the change in the distribution criterion, which now considers exclusively the number of enrollments in primary education, supports the Union\u27s redistributive function, fostering greater equity among the states. The conclusion suggests that states in the North and Northeast will significantly benefit from the Supreme Court\u27s decision, while states with higher tax collection capacity will face challenges in readjusting their budgets within the new distribution framework.Este artigo analisa o impacto da decisão do Supremo Tribunal Federal no caso da Arguição de Descumprimento de Preceito Fundamental 188, que alterou a metodologia de distribuição dos recursos do Salário-Educação, um dos principais mecanismos de financiamento da educação básica no Brasil. A partir de uma análise jurídica e de dados projetados para 2024, o artigo investiga como a mudança do critério de distribuição, que passou a considerar exclusivamente o número de matrículas no ensino fundamental, favorece a função redistributiva da União, propiciando maior equidade entre os estados. A conclusão sugere que estados do Norte e Nordeste se beneficiarão significativamente da decisão do STF, ao passo que estados com maior capacidade arrecadatória enfrentarão desafios para readequar seus orçamentos dentro da nova realidade de distribuição
