AUDIÊNCIA DE CUSTÓDIA PERANTE A PANDEMIA DE COVID-19 E O USO DE VIDEOCONFERÊNCIA

Abstract

Abstract The aim of this article is to address and investigate the main issues surrounding custody hearings in Brazil in the face of the Covid-19 pandemic and the use of technology in criminal proceedings. To this end, the origin, spread and advancement in the sectors of society of the coronavirus, the custody hearing, its constitutional and legal aspects and its application within the courts will be addressed. During the article, the debate between jurists and those involved in the process will be addressed, about the use of technology in the criminal procedural sphere and how this can directly affect the human rights of the detainee and the legality of the act. It is worth noting that it is necessary to inform interested parties of all the debate surrounding the use of videoconferencing in criminal proceedings, where it has been found that there is no internal consensus among jurists or even the public.  O Presente artigo tem como objetivo, abordar e investigar as principais questões acerca da realização das Audiências de Custódia no Brasil, perante a pandemia de Covid-19 e o uso de tecnologia no Processo Penal. Para isso, serão abordadas a origem, propagação e avanço nos setores da sociedade, do coronavírus, a audiência de custódia, seus aspectos constitucionais, legais e sua aplicação dentro dos tribunais. Durante o artigo, será abordado o debate entre os juristas e envolvidos no processo, acerca do uso da tecnologia no âmbito processual penal e como isso pode afetar diretamente os direitos humanos do custodiado e a legalidade do ato. Vale ressaltar que se faz necessário conhecer aos interessados todo debate que vem envolvendo o uso da videoconferência no processo penal, onde se verificou que não existe um consenso interno entre os juristas e até mesmo na população. &nbsp
