O CONSTITUCIONALISMO CONTEMPORÂNEO, A GLOBALIZAÇÃO E O “MAL-ESTAR” NAS CONSTITUIÇÕES DOS PAÍSES PERIFÉRICOS: UMA ANÁLISE DECOLONIAL

Abstract

There is currently a current discourse bout the weakening of state sovereignty. This point will be analyzed in greater depth, as well as clarified more clearly and objectively in this Dissertation. With the study, it will be sought to understand how Constitutional Law was impacted by the changes and evolutions brought about by modern Constitutionalism and Globalization, and also if the fading of political borders definitively affected the concepts of State and its sovereignty. In fact, was there a rupture with the traditional paradigm that the legal system is a pyramid, at the apex of which is the Constitution? To answer these questions, the dissertation analyzes important aspects related to Constitutionalism, Globalization and the "unease" caused in the Constitutions, as well as the historical evolution and its achievements, Social and Contemporary Constitutionalism and, finally, Constitutionalism, Globalization and the “unease” caused in the Constitutions.Atualmente há um discurso corrente sobre o enfraquecimento da soberania do Estado. Ponto esse que será analisado com maior profundidade, bem como esclarecido de forma mais clara e objetiva na presente Dissertação. Com o estudo, procurar-se-á, compreender como o Direito Constitucional foi impactado pelas mudanças e evoluções trazidas pelo Constitucionalismo moderno e pela Globalização, e também se o esmaecimento das fronteiras políticas afetou de forma definitiva os conceitos de Estado e de sua soberania. De fato, houve uma fragilização do paradigma tradicional de que o ordenamento jurídico é uma pirâmide, em cujo vértice encontra-se a Constituição? Para responder estes questionamentos, a dissertação analisa importantes aspectos referentes ao Constitucionalismo, Globalização e o “mal-estar” causado nas Constituições, bem como será estudada a evolução histórica e suas conquistas, o Constitucionalismo Social e Contemporâneo e, por fim, o Constitucionalismo, Globalização e o “mal-estar” causado nas Constituições
