El derecho al gobierno digital en la relación G2C en México

Abstract

This study addresses the absence of a comprehensive legal framework that regulates Digital Government in Mexico and protects the user in the Government-Citizen relationship. It aims to analyze the rights to Digital Government in the country considering: 1) the growing relevance and use of Information and Communication Technologies in public management and 2) the principle of legality that governs all state action. The research aims to classify the rights of citizens to Digital Government through a documentary analysis of the institutional and legal framework at the federal level of Digital Government in Mexico during the period 2019-2024, with an approach based on the hierarchy of laws. The findings reveal that the rights to Digital Government can be grouped into five key dimensions: 1) digital social inclusion, 2) access and completion of procedures and services, 3) right to access public information, 4) protection of personal data and 5) emerging rights such as biometrics and electronic voting. In conclusion, the right to Digital Government in Mexico comprises a set of rights defined with their respective regulatory frameworks and others that are still in the process of regulation as technology advances in the country.El presente estudio aborda la ausencia de un marco jurídico integral que regule el Gobierno Digital en México y proteja al usuario en la relación Gobierno-Ciudadano. Se propone analizar los derechos al Gobierno Digital en el país considerando: 1) la creciente relevancia y uso de las Tecnologías de la Información y la Comunicación en la gestión pública y 2) el principio de legalidad que rige toda acción estatal. La investigación tiene como objetivo clasificar los derechos del ciudadano al Gobierno Digital a través de un análisis documental del marco institucional y jurídico a nivel federal del Gobierno Digital en México durante el período 2019-2024, con un enfoque basado en la jerarquía de las leyes. Los hallazgos revelan que los derechos al Gobierno Digital pueden agruparse en cinco dimensiones clave: 1) inclusión social digital, 2) acceso y realización de trámites y servicios, 3) derecho al acceso a la información pública, 4) protección de datos personales y 5) derechos emergentes como la biometría y el voto electrónico. En conclusión, el derecho al Gobierno Digital en México comprende un conjunto de derechos definidos con sus respectivos marcos normativos y otros que aún están en proceso de regulación conforme avanza la tecnología en el país
