The Reasons for the Differences Among Maliki Jurists According to Ibn Shas Al-Maliki in his Book "عقد الجواهر الثمينة"

Abstract

يهدف هذا البحث إلى رصد الأسباب التي أدت بفقهاء المالكية إلى الاختلاف في الفروع الفقهية رغم اتفاقهم على الأصول الكبرى، من خلال كتاب مالكي اعتنى بإيراد تلك الأسباب مفرقة في مختلف أبوابه، وتتجلى أهمية هذا البحث في كونه تتبع كل مسائل الكتاب الذي جاء بأسباب جزئية متعلقة بمسائل بعينها وجمعها تحت عناوين ترجع إلى أصول الفقه أو قواعده أو ضوابطه أو علوم الحديث أو قواعد العربية أو اختلاف الاجتهاد أو التنزيل، بهدف التعرف على العلل المؤثرة في الخلاف الفقهي ومعرفة كيفية بناء الفروع على الأصول، وقد تم إعمال المنهج الاستقرائي لاستخلاص الأسباب التي أوردها المؤلف بألفاظ صريحة مثل: سبب الخلاف ومنشؤه، واعتماد المنهج التحليلي لتحليل هذه المسائل وبيان تأثير أسباب الخلاف فيها، مع الاكتفاء بالتمثيل بفرع فقهي واحد. وقد تم التوصل إلى أن الاختلاف الفقهي مبني على أسس وضوابط وقواعد علمية، وأن المسألة الفقهية الواحدة قد تؤثر فيها أسباب كثيرة، وأن أكثر الأسباب المؤدية إلى اختلاف فقهاء المالكية راجعة إلى قواعد الفقه وضوابطه.This research aims to identify the reasons that led Maliki jurists to differ in jurisprudential branches despite their agreement on major principles. This is achieved through a Maliki book that addresses these differences across various topics. The significance of this research lies in its comprehensive examination of all the issues presented in the book, which includes specific reasons related to particular matters and organizes them under major causes linked to the foundations of jurisprudence, its rules, or principles, the sciences of hadith, the rules of Arabic, differences in ijtihad, or contextual application. The goal is to understand the factors influencing jurisprudential disagreements and to know how branches are built upon the foundations. An inductive approach was employed to extract the reasons explicitly stated by the author, such as "the cause of disagreement and its origin." At the same time, an analytical method was employed to examine these issues and illustrate the impact of the reasons for disagreement on them, with a specific jurisprudential branch serving as an example
