Implementasi Pasal 8 Ayat 1 Huruf F Uu No. 8 Tahun 1999 Terhadap Konsumen Yang Mendapat Merchandise GMMTV Palsu

Haryono No. 169 Malang e-mail: [email protected]   Abstrak Pasal 8 ayat 1 huruf F Undang-undang No. 8 Tahun 1999 tentang Perlindungan Konsumen mengatur dengan jelas perbuatan yang dilarang bagi pelaku usaha, yaitu memperdagangkan atau memproduksi barang yang tidak sesuai dengan yang diiklankan. Namun pada praktiknya masih terdapat distributor yang menjual merchandise GMMTV palsu di media sosial. Penulis mengangkat dua rumusan masalah yaitu, (1) Bagaimanakah implementasi pasal 8 ayat 1 huruf F Undang-undang No. 8 Tahun 1999 tentang Perlindungan Konsumen terhadap konsumen yang dirugikan dikarenakan mendapat barang palsu saat pembelian merchandise GMMTV di distributor? (2) Apa saja faktor-faktor yang menjadi hambatan terlaksananya perlindungan terhadap konsumen yang mendapat barang palsu dan bagaimana upaya penyelesaiannya sesuai dengan Undang-undang No. 8 Tahun 1999 tentang Perlindungan Konsumen? Penelitian ini menggunakan metode sosio-legal dengan pendekatan penelitian yuridis sosiologis. Data primer dan data sekunder diolah dengan teknik purposive sampling yang dianalisis menggunakan teknik analisis data kualitatif menggunakan teori Lawrence M. Friedman mengenai efektivitas penegakan hukum yaitu substansi hukum, stuktur hukum, dan budaya hukum. Berdasarkan hasil penelitian ini, implementasi pasal belum terlaksana dengan baik. Faktor hambatan datang dari distributor dan konsumen dengan upaya penyelesaian dengan memberikan ganti rugi. Kata Kunci: Distributor, Merchandise GMMTV, Perjanjian Jasa   Abstract Article 8 Paragraph 1 letter F of Law Number 8 of 1999 concerning Consumer Protection regulates the prohibition of conduct committed by businesses by selling or producing items not like those advertised. However, some distributors were found selling fake GMMTV merchandise on social media. Departing from this issue, this research aims to study the following research problems: (1) the implementation of Article 8 paragraph 1 letter F of Law Number 8 of 1999 concerning Consumer Protection especially for aggrieved consumers following the purchase of bogus products of GMMTV merchandise from a distributor; (2) the impeding factors in the implementation of the protection for consumers receiving bogus products and the measures taken to settle the issue according to Law Number 8 of 1999 concerning Consumer Protection. This research employed socio-legal methods and socio-juridical approaches. Primary and secondary data were processed according to purposive sampling, and they were analyzed based on a qualitative technique referring to the theory introduced by Lawrence M. Friedman on the effectiveness of law enforcement, including the substance of law, legal structure, and legal culture. The research results reveal that the Article concerned has not been implemented appropriately due to impeding factors coming from the distributor and consumers. Preventive action was taken to settle the issue by considering law education, while compensation was considered a repressive measure. Keywords: Distributor, GMMTV Merchandise, Service Agreemen
