Possibili sviluppi in tema di contrasto alle mutilazioni genitali femminili: la recente direttiva UE 2024/1385 e gli obblighi per il legislatore italiano

Abstract

Il presente contributo esamina la portata e le implicazioni della direttiva UE 2024/1385 sul rafforzamento del quadro normativo volto al contrasto delle MGF. Il lavoro muove dall’analisi degli strumenti internazionali, adottati sia nell’ambito delle Nazioni Unite che di alcune organizzazioni regionali, che delineano il sistema di norme applicabili in materia. Partendo da tale sistema di norme, specie quelle adottate a livello regionale, il lavoro si sofferma sul ruolo che la direttiva potrà svolgere nel delineare, in linea con la sua funzione armonizzatrice, un quadro normativo non solo uniforme, ma altresì idoneo a garantire la piena attuazione della Convenzione di Istanbul. Saranno analizzate infine le carenze strutturali della legislazione italiana in vigore, alla luce delle critiche avanzate dal GREVIO nell’ultimo Rapporto.This article examines the scope and implications of EU Directive 2024/1385 on strengthening the legal framework for combating female genital mutilation. It firstly focuses on the international instruments adopted within the framework of the United Nations and some regional organizations, that outline the system of applicable rules in this area. Given this normative framework, and especially the system of regional rules, the article analyses the role that the recent EU Directive may play not only in aligning and harmonising national legislations, but also in achieving the goal of full implementation of the Istanbul Convention. Finally, it focuses on the structural weaknesses of Italian legislation in light of the observations made by GREVIO in its last Report
