Judicialização do Regime Geral de Previdência Social brasileiro: análise dos efeitos financeiros e administrativos

Abstract

Objetivo – A pesquisa teve como objetivo principal examinar a evolução e os efeitos financeiros e administrativos da judicialização na busca pelos benefícios do Regime Geral de Previdência Social brasileiro (RGPS), além das possíveis causas e medidas que possam contribuir para a redução do fenômeno e dos seus efeitos. Metodologia – A pesquisa foi realizada por meio de abordagem qualitativa, com a utilização de dados quantitativos complementares. Os dados foram obtidos com a aplicação de entrevistas semiestruturadas e por meio pesquisa documental e analisados por meio do método de análise de conteúdo. Os dados quantitativos foram obtidos por meio de consultas em fontes públicas, principalmente páginas de órgãos públicos na internet, e consultas a órgãos públicos, diretamente ou por meio da Lei de Acesso à Informação. Resultados – Os resultados revelaram as causas de um crescente processo de judicialização na busca pelos benefícios prestados e mantidos pelo RGPS, caracterizadas por uma complexa relação entre o executivo, o judiciário e o legislativo, cada um contribuindo à sua maneira para o fenômeno. Revelaram, ainda, seus efeitos financeiros e administrativos, que afetam e põe em risco não só a sustentabilidade do Regime, mas também a sua eficiência e a de outros órgãos envolvidos no processo. Delimitações – O estudo se delimitou a examinar a evolução e os efeitos financeiros e administrativos decorrentes da judicialização na busca pelos benefícios previdenciários prestados pelo RGPS brasileiro, além das possíveis causas e soluções para esse fenômeno, entre os anos de 2019 e 2023. No entanto, não englobou a judicialização de benefícios assistenciais, também administrados pelo INSS, e os benefícios administrados pelos Regimes Próprios de Previdência. Limitações – A pesquisa encontrou limitação na obtenção de dados quantitativos. Os dados obtidos por meio de consultas a órgãos públicos revelaram-se frágeis e imprecisos, como apontado pelos próprios órgãos em suas respostas, sendo necessário recorrer a outras fontes e dados para enriquecimento e confiabilidade da pesquisa. Aplicabilidade do trabalho – As descobertas feitas por meio da pesquisa possibilitarão ao INSS uma melhor compreensão do fenômeno da judicialização, suas causas e efeitos, na visão dos servidores que trabalham na concessão de benefícios judiciais, possibilitando, assim, atuação em áreas específicas, visando à redução do fenômeno e dos seus efeitos. Contribuições para a sociedade – A relevância da pesquisa para a sociedade reside na possibilidade de identificação das causas para o intenso processo de judicialização dos benefícios do RGPS, propiciando a implementação de políticas públicas que visem à redução desse fenômeno, diminuindo o impacto financeiro e administrativo que a judicialização acarreta para o sistema. Originalidade – A originalidade do estudo está em examinar a judicialização da previdência social brasileira sob a perspectiva dos servidores do INSS. Embora não participem diretamente do complexo processo de gestão e tomada de decisões, esses profissionais acumulam uma experiência prática potencial, adquirida por meio do contato diário com decisões judiciais e da interação próxima com procuradores, advogados, segurados e juízes, o que lhes confere uma visão sistêmica do fenômeno. A originalidade reside, ainda, na análise dos efeitos administrativos da judicialização, refletidos principalmente sobre o estoque de benefícios que aguardam análise no INSS.Objective – The main objective of the research was to examine the evolution and the financial and administrative effects of judicialization in the search for benefits under the Brazilian General Social Security System (RGPS), as well as the possible causes and measures that could contribute to reducing the phenomenon and its effects. Methodology – The research was carried out using a qualitative approach, with the use of complementary quantitative data. The data was obtained through semi-structured interviews and documentary research and analyzed using the Content Analysis method. The quantitative data was obtained through consultations with public sources, mainly public bodies' websites, and consultations with public bodies, either directly or through the Access to Information Act. Results – The results revealed the causes of a growing process of judicialization in the search for benefits provided and maintained by the RGPS, characterized by a complex relationship between the executive, the judiciary and the legislature, each contributing in their own way to the phenomenon. They also revealed its financial and administrative effects, which affect and put at risk not only the sustainability of the Regime, but also its efficiency and that of other bodies involved in the process. Delimitations – The study delimited itself to examine the evolution and financial and administrative effects of judicialization in the search for social security benefits provided by the Brazilian RGPS, as well as the possible causes and solutions to this phenomenon, between the years 2019 and 2023. However, it did not include the judicialization of welfare benefits, which are also administered by the INSS, and the benefits provided by the civil servant’s retirement systems. Limitations – The research encountered limitations in obtaining secondary data. The data obtained through consultations with public bodies proved to be fragile and inaccurate, as pointed out by the bodies themselves in their responses, and it was necessary to resort to other sources and data to enrich the reliability of the research. Applicability of the work –The discoveries made through the research will enable the INSS to gain a better understanding of the phenomenon of judicialization, its causes and effects, from the point of view of the civil servants who work in granting judicial benefits, thus enabling action to be taken in specific areas, with a view to reducing the phenomenon and its effects. Contributions to society – The relevance of the research for society lies in the possibility of identifying the causes of the intense process of judicialization of RGPS benefits, enabling the implementation of public policies aimed at reducing this phenomenon, reducing the financial and administrative impact that judicialization has on the system. Originality – The study's originality lies in examining the judicialization of Brazilian social security from the perspective of INSS employees. Although they do not participate directly in the complex process of management and decision-making, these professionals have accumulated potential practical experience, acquired through daily contact with judicial decisions and close interaction with prosecutors, lawyers, insured people and judges, which gives them a systemic view of the phenomenon.
