BENTUK TANGGUNGJAWAB NEGARA TERHADAP KASUS REPATRIASI PAKSA PENGUNGSI KOREA UTARA OLEH REPUBLIK RAKYAT CINA

Abstract

Human rights violation in North Korea is the result of authoritarian regime that led by kim dinasty. North Korean citizen has been suffering from persecution by the regime and few of them choose to flee from North Korea to another country. People Republic of China border security often capture and send back North Korean refugee to their country. The purpose of the research is to analyzed People Republic of China state responsbility due to forced raptriation case of the North Korean refugee. The conclusion of the research later will be obtained by the data that has been gathered. This research conclude that the People Republic of China violated the international law by not complying with the non-refoulement provisions contained in the 1951 Geneva Convention. For not adhere to the 1951 Geneva Convention, People Republic of China can be held liable according to state responsibility
