Abstract

The reprehensible practice of creating brands or products similar to those already established in the market, causing consumer confusion during the selection process, is more common than one might imagine from a legal perspective. This study aims to outline the legal importance of these intangible assets and the repression of unfair competition. The research method employed is deductive, utilizing a methodological approach that includes doctrinal, legislative, and jurisprudential research. It seeks to analyze the connections between consumer protection in the market and the repression of unfair competition. To achieve better results and contributions, the primary focus of the research is on the use of real cases where the use of similar signs was discussed, as a way to verify whether legal professionals have correctly interpreted the subjective message of the brand, considering the level of consumer awareness or information in the market.A prática reprovável de criar marcas ou produtos semelhantes aos já consolidados no mercado, levando o consumidor a se confundir na hora da escolha, é mais comum do que se imagina sob o ponto de vista jurídico. Este estudo tem por objetivo traçar a importância jurídica sobre estes bens incorpóreos e a repressão à concorrência desleal. O método de pesquisa empregado é o dedutivo, por meio de procedimento metodológico de pesquisa doutrinária, legislativa e jurisprudencial, buscando analisar pontos de conexão entre a proteção do consumidor no mercado e a repressão à concorrência desleal. Como forma de obter melhores resultados e contribuições, a pesquisa possui como orientação principal a utilização de casos concretos em que houve a discussão da utilização de signos semelhantes, como forma de verificar se o operador do direito tem interpretado corretamente a mensagem subjetiva da marca, levando em consideração o nível de esclarecimento ou informação do consumidor no mercado
