Prompts De La Inteligencia Artificial Generativa Y Su Posible Protección Por La Propiedad Intelectual

Abstract

The prompt in Artificial Generative Intelligence, hereinafter IAG, is a literary text that is inserted into IAG software applications as input that gives rise to literary, visual, audiovisual creations, software or any other creative manifestation. The growing use and importance have determined various interests in defining whether some type of Intellectual Property protection can be considered in this regard. It has a functional component, although it is not protected from a technological point of view by Intellectual Property. It is analyzed whether it can be considered, as a literary expressión, a copyrightable work, or include trademark expressions. A succession of prompts is more likely to express originality of the operator and be protectable by Copyright. Without prejudice to the fact that their generation involves work and intellectual contribution, the operator who inserts them has no impact on the creative process of the IAG, so it is understood that he cannot be classified as the author of the creations of the IAG, in case these protectable works could be understood.El prompt en la Inteligencia Artificial Generativa, en adelante IAG, es un texto literario que se inserta en aplicativos de software de la IAG como input que da lugar a creaciones literarias, visuales, audio visuales, software o cualquier otra manifestación creativa. La creciente utilización e importancia han determinado diversos intereses en definir si puede plantearse algún tipo de protección de la Propiedad Intelectual a su respecto. Tiene un componente funcional, aunque no es objeto de protección desde el punto tecnológico por la Propiedad Intelectual. Se analiza si puede consistir también, como expresión literaria en objeto de protección por Derecho de Autor o incluir expresiones marcarias. Una sucesión de prompts tiene más probabilidades de expresar originalidad del operador y ser protegible por Derecho de Autor. Sin perjuicio de que su generación implica trabajo y aporte intelectual, el operador que los inserta no tiene incidencia en el proceso creativo de la IAG, de mane ra que se entiendo que no puede calificarse como autor de las creaciones de la IAG, en caso que estas se pudieran entender obras protegibles
