Embriaguez ao volante em Curitiba: o enfrentamento penal e a construção de uma ética viária sustentável

Abstract

O artigo examina a problemática da embriaguez ao volante em Curitiba/PR, abordando os aspectos penais, éticos e sociais relacionados aos crimes de trânsito. A pesquisa analisa a interação entre o Código Penal e o Código de Trânsito Brasileiro (CTB), com foco na distinção entre dolo eventual e culpa consciente em acidentes fatais. Utilizando uma metodologia baseada em revisão bibliográfica e análise de dados oficiais, como os fornecidos pelo Detran/PR, o estudo explora decisões judiciais relevantes e o impacto das políticas públicas preventivas. Os resultados indicam que, embora medidas como blitz policiais e campanhas educativas tenham algum efeito, as infrações relacionadas à embriaguez ao volante permanecem significativas. Conclui-se pela necessidade de uma harmonização legislativa entre o CTB e o Código Penal, promovendo penas mais rígidas e consistentes. No entanto, o trabalho destaca que a questão vai além da punição: são essenciais medidas educativas, investimentos em infraestrutura de transporte público e mudanças culturais que incentivem a construção de uma ética viária sustentável, comprometida com a valorização da vida e a segurança coletiva no trânsito.This article examines the issue of drunk driving in Curitiba/PR, addressing the legal, ethical, and social aspects related to traffic crimes. The research analyzes the interplay between the Penal Code and the Brazilian Traffic Code (CTB), focusing on the distinction between eventual intent and conscious negligence in fatal accidents. Using a methodology based on bibliographic review and analysis of official data, such as those provided by Detran/PR, the study explores relevant judicial decisions and the impact of public policies aimed at prevention. The results reveal that, despite measures such as police checkpoints and educational campaigns, infractions related to drunk driving remain significant. The study concludes by emphasizing the need for legislative harmonization between the CTB and the Penal Code, proposing stricter and more consistent penalties. However, the issue goes beyond punishment: the research highlights the importance of educational initiatives, investments in public transportation infrastructure, and cultural changes that promote the development of a sustainable traffic ethics, committed to valuing life and ensuring collective safety on the roads
