ENFORCEMENT ON BANK ACCOUNTS

Abstract

Ovrha novčanih sredstava predstavlja važan mehanizam unutar pravnog sustava Republike Hrvatske, koji omogućuje vjerovnicima prisilnu naplatu njihovih potraživanja blokadom i zapljenom novčanih sredstava dužnika. Središnji zakonski okvir koji regulira ovu materiju jest Zakon o ovršnom postupku (ZOP), prema kojemu se ovrha provodi na temelju vjerodostojne isprave koja dokazuje dugovanje. Proces uključuje donošenje rješenja o ovrsi od strane suda, nakon čega slijedi blokada bankovnih računa dužnika radi osiguranja naplate. Ovrha novčanih sredstava predstavlja složen pravni proces koji donosi izazove i za vjerovnike i za dužnike. Iako je vjerovnicima omogućena prisilna naplata, dužnicima su zajamčena imovinska prava i zaštita kroz zakonski definirane procedure. Pravna transparentnost i dostupnost pravnih lijekova ključni su elementi koji osiguravaju da se ovršni postupak provodi u skladu sa zakonom, pružajući obje strane u postupku ravnotežu između prisilne naplate i zaštite prava.Enforcement on bank accounts is an important mechanism within the legal system of the Republic of Croatia, which enables creditors to forcibly collect their claims by blocking and confiscating the debtor's funds. The central legal framework that regulates this matter is the Enforcement Procedure Act (ZOP), according to which enforcement is carried out on the basis of an authentic document proving the debt. The process involves the passing of an enforcement order by the court, followed by the blocking of the debtor's bank accounts to ensure collection. Foreclosure is a complex legal process that brings challenges for both creditors and debtors. Although forced collection is enabled for creditors, debtors are guaranteed property rights and protection through legally defined procedures. Legal transparency and the availability of legal remedies are key elements that ensure that enforcement proceedings are carried out in accordance with the law, providing both parties in the proceedings with a balance between enforcement and the protection of rights
