Las sentencias constitucionales del Tribunal Constitucional de República Dominicana

Abstract

Presidente de la Seccional Dominicana del Instituto Iberoamericano de Derecho Constitucional.En este trabajo se estudian las tipologías de algunas sentencias dictadas por el Tribunal Constitucional de República Dominicana las cuales, como se verá, coinciden, en sentido general, con las de los demás tribunales constitucionales. La investigación parte de la premisa de que el paradigma kelseniano, consistente en asimilar al Tribunal Constitucional a un legislador negativo, ha sido superado por la realidad y la práctica. Desde hace décadas esos tribunales no se limitan a dictar sentencias estimatorias (que acogen la acción de inconstitucionalidad) o sentencias desestimatorias (que rechazan la acción de inconstitucionalidad), sino que dictan las denominadas sentencias interpretativas en sus distintas modalidades.// This paper examines the typologies of certain judgments handed down by the Constitutional Court of the Dominican Republic, which, as will be seen, generally coincide with those of other constitutional courts. The research starts from the premise that the Kelsenian paradigm, consisting of likening the Constitutional Court to a negative legislator, has been surpassed by reality and practice. For decades, these courts have not been limited to issuing affirmative judgments (which uphold the action of unconstitutionality) or negative judgments (which reject the action of unconstitutionality), but rather they issue what are known as interpretative judgments in their various forms
