The management of assets and rights of unemancipated subject to parental power or guardianship

Embargado hasta el 21/02/2026Este trabajo se centra en el estudio de la gestión de los bienes y derechos de los menores de edad no emancipados, sometidos a patria potestad o tutela en el ámbito del Derecho Civil común, realizando además una comparativa con los preceptos concordantes en las legislaciones civiles «forales o especiales» vigentes. El objetivo principal de la investigación es analizar el régimen jurídico de estos bienes y derechos, y determinar cómo se gestionan, a quién corresponde la gestión, los límites, consecuencias, etc. De este modo, la tesis aborda, en un primer lugar, a modo de introducción, los mecanismos de protección para los menores no emancipados que existen en el Derecho, y a continuación, se centra en un análisis exhaustivo y actualizado sobre la gestión de los bienes y derechos de los menores de edad no emancipados sometidos a patria potestad o tutela, prestando especial atención a las modificaciones introducidas por la Ley 8/2021 en esta materia. Todo ello, con el fin de mejorar la protección y garantizar la correcta gestión de su patrimonio. Finalmente, se presentan las principales ideas extraídas, y se proponen algunas soluciones.This work focuses on the study of the management of the assets and rights of unemancipated minors, subject to parental authority or guardianship in the scope of the Common Civil Law, also making a comparison with the concordant precepts in the «foral or special» civil legislations in force. The main goal of the research is to analyse the legal regime of these goods and rights, and to decide how they are managed, to whom the management corresponds, the limits, consequences, etc. Thus, the thesis addresses, first, by way of introduction, the protection mechanisms for unemancipated minors that exist in the Law, and then, it focuses on an exhaustive and updated analysis of the management of the assets and rights of unemancipated minors subject to parental authority or guardianship, paying special attention to the modifications introduced by Law 8/2021 in this matter. All this, with the purpose of improving the protection and guaranteeing the correct management of their patrimony. Finally, the main ideas extracted are presented, and some solutions are proposed
