La protección de la maternidad en el contexto de la economía colaborativa incidencia en el sostenimiento del sistema de seguridad social integral

Abstract

En Colombia, la maternidad y su protección, ha evolucionado desde la jurisprudencia y la ley, en especial frente a la estabilidad laboral que tiene la madre trabajadora previo al momento del parto y posterior a ello; estando supeditadas a un contrato de trabajo, desfigurándose cuando la vinculación sea en calidad de independiente. Dentro del marco de la economía colaborativa, la cual si bien es cierto es una gran oportunidad de optimización de los recursos y genera crecimiento económico a través de la innovación, no se ha adentrado en esas nuevas modalidades de empleo que suscitan y que se salen del contexto normativo laboral actual, diferenciando la protección a la maternidad desde una vinculación formal e informal; dejándose de lado los aportes al Sistema de Seguridad Social Integral en el contexto de la economía colaborativa y con ello, el impacto y afectación del sostenimiento financiero del sistema.In Colombia, motherhood and its protection have evolved from jurisprudence and law, especially regarding the job stability that the working mother has prior to the moment of childbirth and after it; being subject to an employment contract, disfigured when the relationship is as an independent.
