La extinción de dominio en la legislación mexicana: su justificación jurídico-valorativa

Abstract

This article discusses the recent Mexican process to establish civil forfeiture as a legal i nstrument to fight organized crime. The author concludes that this figure corresponds to an in personam right of compensation, which corresponds to society and upon which the state acts as plaintiff. The paper answers objections that have been put forth ag ainst this legal institution in Mexico.Se analiza el reciente proceso mexicano para establecer la extinción de dominio como instrumento jurídico para el combate al crimen organizado. Se concluye que esta figura corresponde a un derecho personal indemnizatorio, del que es titular la sociedad y que se ejerce a través del Estado, y se da res puesta a las críticas que a esta figura se han hecho en México
