LA TUTELA TRANSNACIONAL COMPARTIDA (TTC) COMO SUPERIOR INTERES DE LOS MENORES EXTRANJEROS NO ACOMPAÑADOS CON VINCULOS FAMILIARES

Abstract

The dissertation examines the situation of unaccompanied children in Europe and the means of reception by Social Services to demonstrate that the way in which they are treated assumes that they do not have a family. Drawing on instruments of quantitative and qualitative research it is demonstrated that most of the children have made the migration journey in agreement with their family, and maintain frequent contact with them using new information and communication technologies (ICT). Through a reflection on the need for a Best Interest Determination (BID) suitable for minors, the thesis proposes a Shared Transnational Guardianship (STG) as in the best interests of unaccompanied children with a migrant economic project. The STG would be a collaboration between the Social Services in the country of arrival of the child and the family in the country of origin, and would be a form of decentralized cooperation.La tesi di dottorato prende in esame la situazione dei minori stranieri non accompagnati in Europa e le modalità di accoglienza da parte dei Servizi Sociali, per dimostrare che il trattamento si realizza come se essi non avessero una famiglia. Attraverso gli strumenti di indagine quantitativa e qualitativa si evidenzia che la maggior parte dei minori ha affrontato la migrazione in accordo con la famiglia e che mantiene con quest’ultima una relazione frequente grazie alle nuove tecnologie di informazione e comunicazione. Riflettendo sulla necessità di una adeguata Best Interest Determination (BID) dei minori si propone un tipo di Tutela Transnazionale Condivisa (TTC) al fine di garantire il superiore interesse dei minori stranieri non accompagnati il cui progetto migratorio è di carattere economico. La TTC presuppone una collaborazione tra i Servizi Sociali nel Paese in cui arriva il minore e la famiglia nel Paese di origine, e prevede una modalità di cooperazione decentrata.Cotutela con Universidad Pontificia de Comilla
