En esta investigación doctoral se estudian los fundamentos y límites
de la responsabilidad jurídico-penal del jefe o superior jerárquico de
organizaciones delictivas por los delitos cometidos por sus
subordinados. En especial, se quiere responder si es posible
imputarles los excesos, así dichas actuaciones no hayan sido
contempladas en las órdenes inicialmente impartidas. Para
solucionar este problema jurídico, en primer lugar, se analizan a las
organizaciones delictivas a partir de distintos enfoques para
determinar el objeto de estudio. En segundo lugar, se estudian las
respuestas que, a partir de la evolución del Derecho penal
internacional, se han ofrecido para delimitar la responsabilidad del
superior jerárquico. En tercer lugar, se describen los paradigmas
dogmáticos para abordar este problema jurídico desde el Derecho
penal europeo-continental. Finalmente, en cuarto lugar, se plantea
una propuesta de solución a partir de un enfoque metodológico
sustentado, primero, en establecer el fundamento de la
responsabilidad del individuo, segundo, en la calificación de su
intervención y, tercero, en determinar el alcance de la imputación
subjetiva del injusto.This PhD thesis studies the foundations and limits of the criminal
responsibility of criminal organizations’ commanders or superiors
for the crimes committed by their subordinates. It is aimed to
revolve if it is possible to charge them for the excesses, even if
those actions were not contemplated in the orders initially given. To
solve this legal problem, first, criminal organizations are analyzed
from different approaches to determine the object of study.
Secondly, the answers from the evolution of international criminal
law have been offered to delimit the command responsibility are
analyzed. Thirdly, the dogmatic paradigms are analyzed to address
this legal problem from the continental European legal system.
Finally, in the fourth place, it is proposed a solution from a
methodological approach based, first, on establishing the foundation
of the individual's responsibility, second, on the qualification of his
intervention and, third, on determining the scope of the subjective
