Let ex societas: Visión apocalíptica sobre la terminación de las libertades en el escenario de pandemia y los límites del poder estatal frente a los DDHH

Abstract

The relationships between society and its condition of subordination to the state and how the latter exercise its power over it, corresponds to a historical debate that has left us with different models of relationship between man and state power, where the freedoms of the former and the second's obligations are a constant object of confrontation. In this understanding and placing ourselves in the contemporary framework which has been marked by different historical social dynamisms, we find ourselves with the dilemma about the limits of state influence on individuals in the framework of a pandemic that led to a State of exception and different social struggles rooted in it for the defense of basic rights. It is because of the above that this work seeks to highlight constitutional guidelines and international systems that guarantee the protection of human dignity in different crisis contexts to provide a holistic view of the importance of a legal, legal and social nature of the protection of human rights. rights and freedoms against the power of the State in our times that guide the social course from the institutional and legal channels against abuses and excesses of public powers.Undoubtedly, the pandemic generated an unprecedented situation in which we were affected absolutely each and every one of the human activities, which regardless of the social or economic condition we are threatened, where the resolutions by the government to deal with, have consequently been without precedents and out of the ordinary.Las relaciones entre la sociedad y su condición de subordinación ante el estado y cómo éste ejercer su poder sobre ella, corresponde a un debate histórico que nos ha dejado distintos modelos de relación entre el hombre y el poder estatal, donde las libertades del primero y las obligaciones del segundo son objeto constante de confrontación. En este entendido y ubicándonos en el marco contemporáneo el cual ha estado marcado por diferentes dinamismos sociales trascendentales, nos encontramos con el dilema sobre los límites de la influencia estatal en los individuos en el marco de una pandemia que conllevó a un Estado de excepción y diferentes luchas sociales enraizadas en la misma por la defensa de los derechos básicos.  Es por lo anterior que el presente trabajo busca resaltar lineamientos constitucionales y de sistemas internacionales garantes de la protección de la dignidad humana en los diferentes contextos de crisis para brindar una visión holística de la importancia de índole jurídica, legal y social de la protección de los derechos y libertades frente al poder del Estado en nuestros tiempos que guían el rumbo social desde la vía institucional y cauces legales frente a abusos y extralimitación de los poderes públicos.  Indubitablemente la pandemia generó una situación inaudita en la cual vimos afectados absolutamente todas y cada una de las actividades humanas, que independientemente de la condición social o económica nos encontramos amenazados, donde las resoluciones por parte del gobierno para hacer frente han sido en consecuencia sin precedentes y fuera de lo habitual
