KONSEP HUKUMAN DALAM ISLAM (Telaah Ayat Ahkam tentang Hukum dalam Perspektif Hukum Tata Negara)

Abstract

ABSTRACT: The ultimate goal of God's law is to preserve the benefits of human beings, whether it is for the benefit of themselves or for the public. The act deemed guilty and no suggestion to work shall be punished in accordance with the prevailing provisions. Therefore, this study is to examine how the concept of punishment in Tafsir ayat Ahkam and views of the Law of State. In this study uses a comparative analysis of three interpretations, namely the interpretation of Al-Misbah, the interpretation of Al-Qurthubi, and Ibn Katsir.The data used to make this paper is the primary data derived from the Qur'an and the secondary data is sourced from other sources related to this problem. This study is done by interpretation method through comparison techniques between verses of the Qur'an, or concerning the editorial of different sentences but with the same problem, and the opinions of the scholars in the interpretation. Based on the results of the study of QS.Yusuf verse 33 and verse 42 and QS.Al-Maidah verse 33 shows about the punishment for those who forget the provisions Allah. ABSTRAK: Tujuan utama disyariatkannya hukum oleh Allah untuk melindungi kemaslahatan manusia, baik untuk kemaslahatan diri sendiri ataupun orang banyak. Perbuatan yang dianggap bersalah dan tidak ada anjuran untuk mengerjakan maka akan dihukum sesuai ketentuan yang berlaku. Maka, penelitian ini untuk menelaah bagaimana konsep hukuman dalam Tafsir ayat Ahkam dan pandangan Hukum Tata Negara. Dalam penelitian ini menggunakan analisis komparatif terhadap tiga tafsir yaitu tafsir Al-Misbah, tafsir Al-Qurthubi, dan Ibnu Katsir.Data yang digunakan untuk membuat makalah ini adalah data primer bersumber dari Al-Qur’an dan data sekunder bersumber dari sumber lain yang berkaitan mengenai masalah ini.Penelitian ini dilakukan dengan metode penafsiran melalui teknik perbandingan antar ayat-ayat Al-Qur’an, ataupun mengenairedaksi kalimat yang berbeda tetapi dengan masalah yang sama, dan berbagai pendapat para ulama dalam penafsiran.Berdasarkan hasil penelitian dari QS.Yusuf ayat 33 dan ayat 42 serta QS.Al-Maidah ayat 33 menunjukan mengenai hukuman bagi orang-orang yang lupa terhadap ketentuan Allah
