Legal regulation of children and youth volunteerism in Russia

Abstract

В докладе рассматриваются нормативно-правовые особенности регулирования детского и юношеского волонтерства в России. Авторы обращаются к анализу правовых норм российского законодательства, затрагивающих аспекты деятельности детских и юношеских добровольческих объединений, и сообществ, особенности организации добровольческих инициатив детей и подростков в сферах образования и социального обеспечения, культурнодосуговой сфере и некоммерческом секторе. В качестве основных проблем правового регулирования детско-юношеского волонтерства авторы обозначают: неопределенность нормативно-правового определения понятия «волонтер» в российском законодательстве; ограниченность прав, обязанностей и возможностей детей разных возрастных групп, которая накладывает определенные рамки на их деятельность как добровольцев; непроработанность механизма реализации ряда определенных российским законодательством норм в отношении организации детского и юношеского волонтерства в разных сферах жизни российского общества. Авторы выделяют, что для детей и подростков практически отсутствует возможность выступать самостоятельным субъектом волонтерской деятельности. Основная роль в реализации детско-юношеского волонтерства предписывается организаторам добровольческих инициатив. По отношению к их статусу и возможностям не всегда проработана нормативно-правовая база.The report examines the legal regulation of particular children and youth volunteerism in Russia. The authors refer to the analysis of legal norms of the Russian legislation affecting aspects of children's and youth voluntary associations and communities, especially the organization of volunteer initiatives of children and adolescents in the areas of education and social welfare, cultural and leisure sector and the nonprofit sector. The authors refer to as the main problems of legal regulation of youth volunteering: the uncertainty of the regulatory definition of "volunteer" in the Russian legislation; limitations of rights, obligations and opportunities for children of different age groups, which imposes certain limits on their activities as a volunteer; unfinishedintegrity of the mechanism for the implementation of a number of specific rules of Russian law on the organization of children's and youth volunteering in different spheres of life of Russian society. According to Russian legislation for children and adolescents is practically no opportunity to perform an independent subject of volunteering. The main role in implementing youth volunteering prescribed by the organizers of volunteer initiatives. In relation to their status and opportunities are not always worked out the legal framework.
