Jednolity system ochrony patentowej

WrocławThe aim of the article is to discuss the problems connected with introducing the unitary patent system, the so-called patent package, which comprises the European unitary patent, and the Unified Patent Court. The article presents the origin of creating the unitary patent system with the consideration of the most significant views on the subject over the years. At the same time, the legal basis for the creation of the said system based on strengthened cooperation of the majority of Member States, as well as the objections raised in connection with it by Member States opposing it, were elaborated. In this scope, the article discusses two European regulations introducing strengthened cooperation in the field of obtaining European unitary patents, i.e. the regulation of the European Parliament, regulations of the Council no. 1257/2012 and 1260/2012 as well as the international agreement on the Unified Patent Court, contained in the document of the Council no. 16351/12. The European unitary patent was described with particular emphasis on its language system as well as the effects it will have once it becomes binding. Also, the legal status, the structure and the competence of the Unified Patent Court, which will be competent for settling disputes arising in connection with European patents, as well as European unitary patents were discussed. Zasady świadczenia usług w zakresie gier hazardowych w prawie Unii Europejskiej

WrocławThe paper presents principles of providing gambling services in European Union law. This article is based not only on a legal perspective, but also shows external factors that make the present subject so attractive. Ethic, religious aspects and a strong economic background of this topic seem to have impact on legal regulations. European Union law does not contain a particular „gambling act”, thus the Court of Justice of the European Union functions de facto as a lawmaker. A quite significant number of judgements in this area allows to decode some common rules on the basis of which the Member States are entitled to limit an organization of this type of entertainment. Fundamentals for this competence are established by the doctrine of overriding reasons in the public interest, restricted, however, by the requirements of nondiscrimination, proportionality and cohesion of restrictions. WrocławLaw of direct taxation of Member States is subject to verification of its compliance with European Union law from the point of view of the freedoms of internal market. The Union has no competence in the sphere of direct taxation of companies’ income in Member States. It has, however, competence to examine the compliance of provisions of internal tax law with fundamental freedoms of internal market. In the result of that process, some norms of internal law are eliminated or claimed to be inapplicable as infringing the fundamental freedoms. This is the process of negative harmonization of internal laws, which is of special importance in the sphere of tax laws of Member States. The fundamental freedoms are not, however, absolute – their application is limited by the existence of the number of exceptions, established by the jurisprudence of the Court of Justice of European Union. Zasada wzajemnego zaufania państw członkowskich Unii Europejskiej jako podstawa budowania europejskiej przestrzeni karnej

WrocławThe master thesis entitled: “Zasada wzajemnego zaufania państw członkowskich Unii Europejskiej jako podstawa budowania Europejskiej Przestrzeni Karnej” analyses the changing model of cooperation between EU Member States in criminal matters. The author tries to form a critical image of the EU and its Member States activities aimed at building the so-called European Criminal Area. The sphere which, like the single market with economic freedoms, postulates the creation of a single area in criminal matters with free movement of judicial and extrajudicial decisions in the EU. The author ask a question about the basis of this advanced form of cooperation between sovereign states. According to the doctrine, the most adequate justification for this new dimension of interstate cooperation is the principle of mutual trust. The thesis describes this phenomenon, which in the EU is going to replace a basic principle of international law - the principle of reciprocity.
