The role of the State Labour Inspection in the system of sexual crime prevention and the protection of minors

Artykuł obejmuje analizę ustawowej roli Państwowej Inspekcji Pracy jako podmiotu zobowiązanego do działań w zakresie prewencji przestępczości seksualnej oraz ochrony małoletnich. Celem pracy jest ustalenie instrumentów przysługujących PIP w obszarze realizacji założeń przeciwdziałania zagrożeniom przestępczością na tle seksualnym. W artykule przeanalizowano założenia systemowe prewencji na gruncie ustawy z dnia 13 maja 2016 r. o przeciwdziałaniu zagrożeniom przestępczością na tle seksualnym i ochronie małoletnich w kontekście uprawnień kontrolnych PIP. Oceniono aktualne uprawnienia PIP przy uwzględnieniu zarówno systemu prewencji przestępczości seksualnej, jak i postępowania karnego oraz kompetencji tego organu na gruncie ustawy o Państwowej Inspekcji Pracy. Przeprowadzona analiza pozwoliła na sformułowanie postulatów de lege ferenda w postaci rozszerzenia uprawnień PIP odnośnie do kontroli wprowadzenia standardów ochrony małoletnich, jak również wniosków de lege lata w zakresie uprawnienia do powiadamiania organów ścigania o naruszeniach prawa, które wykraczają poza obszar kontroli. The article provides an analysis of the statutory role of the State Labour Inspection as an entity obliged to undertake activities in the field of sexual crime prevention and the protection of minors. The aim of the study is to identify the instruments available to the State Labour Inspection in implementing the objectives of counteracting threats related to sexual offences. The article analyses the systemic premises of prevention under the Act of 13 May 2016 on Counteracting Threats of Sexual Offences and the Protection of Minors, in the context of the inspection powers of the State Labour Inspection. The current powers of the State Labour Inspection were assessed with due regard to both the system of sexual crime prevention and criminal proceedings, as well as the competences of this authority under the Act on the State Labour Inspection. The analysis conducted made it possible to formulate de lege ferenda proposals in the form of extending the powers of the State Labour Inspection with regard to monitoring the implementation of standards for the protection of minors, as well as de lege lata conclusions concerning the authority to notify law enforcement agencies of legal violations that fall outside the scope of inspection

Philosophical and Legal Take on Hippocrates' Thought

Medycyna oraz prawo medyczne już od czasów starożytnych są zagadnieniami budzącymi zainteresowanie wśród filozofów, lekarzy i prawników. To ujęcie historyczne pozwala zaś lepiej zrozumieć istotę medycyny. Przysięga Hipokratesa jest istotnym fundamentem etyki medycznej stanowiącej nieodłączną podstawę rzetelnego wykonywania zawodu lekarza. Składa się z dziewięciu części, które dotyczą przymiotów, wartości i postawy lekarza, jak również konkretnych obowiązków wobec pacjenta oraz etycznego charakteru relacji między pacjentem a lekarzem. Celem artykułu jest analiza myśli filozoficznej „ojca medycyny” – Hipokratesa. Koncepcja racjonalno-empiryczna praktykowana przez lekarza z Kos stała się podstawą medycyny. Jego myśl oparta jest na holistycznym podejściu do człowieka, pacjenta oraz jego zdrowia. Etos hipokratejski zawiera zbiór zasad etycznych, którymi powinien kierować się lekarz. Interpretacja przysięgi Hipokratesa i jej ujęcie w kontekście współczesnej praktyki medycznej pozwoli na ukazanie nowych wyzwań, przed którymi postawieni zostali przedstawiciele zawodów medycznych. Medicine and medical law have been subjects of interest to philosophers, doctors and lawyers from ancient times right up to the present day. A historical perspective allows for a better understanding of the essence of medicine. The Hippocratic Oath is a vital foundation of medical ethics, forming an integral basis for the conscientious practice of the medical profession. It consists of nine parts, which concern the qualities, values and attitudes of the physician, as well as specific duties towards the patient and the ethical nature of the relationship between patient and physician. The aim of this article is to analyse the philosophical thought of „the father of medicine” – Hippocrates. The rational-empirical approach practised by the physician from Kos has become the ethos of medicine. His philosophy is based on a holistic approach to the human being, the patient and their health. The Hippocratic ethos comprises a set of ethical principles which a doctor should follow. An interpretation of the Hippocratic Oath and its consideration within the context of contemporary medical practice will highlight the new challenges facing members of the medical profession

Dialogue Ad Intra: The Relevance of Lumen Gentium and Christus Dominus for a Synodal Church

In order to outline the Council’s understanding of the “dialogue ad intra,” the article will first provide a brief introduction to the concept of dialogue within the Church as set out in selected conciliar documents. To illustrate the Council’s ecclesiological framework for promoting dialogue, an outline of Pope Paul VI’s encyclical Ecclesiam suam will follow. As documents such as Lumen gentium and Christus Dominus were the result of compromises between opposing theological factions at the Council, they sometimes offer inconsistent ecclesiological concepts, which affect later understanding of dialogue within the Church. Therefore, the ecclesiological concepts of “apostolicity” and “true equality” of all the baptised will be examined in terms of their implications for ecclesial counselling, decision-making, and accountability procedures. The final passage will present a proposal for resolving the tensions be­tween opposing concepts of dialogue within the Church, in light of the Church’s understanding of itself as a “complex reality.” (LG 8

John’s Farewell Discourse under the Shadow of Mark

The lengthy discourses of John’s Gospel are a feature of the Evangelist’s writing which has contributed to the idea that he wrote independently of other Gospels. The absence of such discourses in the Synoptics might suggest that John’s discourses are idiosyncratic vehicles for theologizing, wherein Jesus’ speech mirrors Johannine idiom. In this article, I re-examine Jesus’ farewell discourse in John 13–17 in light of the view that John is dependent on Mark’s Gospel. Although John 13–17 is not often considered a connection between these Gospels, I argue that John built this material from Mark 12–14, seeking to improve and expand Mark in a competitive literary marketplace and to persuade his readers to view Jesus and themselves in a particularly Johannine way. John’s compositional practices in his farewell discourse material be compared with two Jewish texts (Chronicles and Jubilees) which reinterpret earlier source material to create farewell discourses

The EU AI Act and the Rights-Based Approach to Technological Governance

The European Union AI Act constitutes an important development in shaping the Union’s digital regulatory architecture. The Act places fundamental rights at the heart of a risk-based governance framework. The article examines how the AI Act institutionalizes a human-centric approach to AI and how the AI Act’s provisions explicitly and implicitly embed the protection of rights enshrined in the EU Charter of Fundamental Rights. It argues that fundamental rights function not merely as aspirational goals, but as legal thresholds and procedural triggers across the life cycle of an AI system. The analysis suggests that the AI Act has the potential to serve as a model for rights-preserving AI systems, while acknowledging that challenges will emerge at the level of implementation.EU/EACEA. Środki prawno-organizacyjne ochrony zabytków przed powodzią na przykładzie wydarzeń z 2024 roku

The publication focuses on legal and organisational measures serving to protect cultural heritage during flooding, considered in the context of events that took place in Poland in September 2024. Our aim was to identify legal and organisational tools for protecting cultural heritage, such as monuments, during times of flooding. The article employs theoretical methods, such as review and analysis of legal and organisational measures for protecting monuments against flooding. Government and ministerial documents as well as relevant literature were analysed. Our analysis was descriptive and analytical and relied on secondary data. Of the many legal and organisational measures serving to protect monuments from flooding and respond to their consequences, the following measures should be highlighted: law, governmental guidelines, national and international aid programmes, appointment of a coordinator for the protection of monuments in the event of flooding, the creation of national financial reserves, and international cooperation. Publikacja koncentruje się na środkach prawno-organizacyjnych służących ochronie dziedzictwa kulturowego w obliczu powodzi, na przykładzie zdarzeń, które miały miejsce w Polsce we wrześniu 2024 roku. Celem artykułu było wyszukanie narzędzi prawno-organizacyjnych służących do ochrony dziedzictwa kulturowego, w tym zabytków podczas pojawienia się powodzi. W artykule wykorzystano metody teoretyczne, takie jak przegląd i analizę prawno-organizacyjnych środków zabezpieczających zabytki przed powodzią. Poddano też analizie dokumenty rządowe i resortowe, a także literaturę przedmiotową. Analiza miała charakter deskryptywno-analityczny i opierała się na danych wtórnych.
