Окремі проблеми досудового розслідування вуличних шахрайств і шляхи їх вирішення

The subjects of the study are the problems that arise at the initial stage of the investigation of street fraud, the study is the individual problems of pre-trial investigation of street fraud and the ways of their solution. The study aims to highlight the most common problems in practice at the initial stage of the investigation of this group of fraud, and presents recommendations for their solution. In the course of time, general scientific methods of cognition were used. The relevance of the research topic is that the main problems of investigators arise at the stage of the decision to open criminal proceedings. Difficulties are related to the fact that the investigator needs to take a key procedural decision based on the analysis of very limited information about the event. In addition, in the context of open criminal proceedings, it is very difficult to form a system of evidence of the existence of a criminal intention in the actions of a fraudsters. Indeed, unlike other crimes, they are reflected not so much in material traces as in acts of intellectual nature: the reporting of false information, the use of fictitious documents, specific attributes, and many others. Gathering evidence of such an order requires an extraordinary level of professionalism. The investigator should not only have a high level of knowledge of the existing criminal and criminal procedural legislation, but also be aware of ways to overcome the main difficulties encountered in criminal proceedings on fraud. The novelty of the results is that the research in this direction was conducted for the first time. The main results of the study are given a number of typical problems of investigation of street fraud, as well as recommendations for their overcoming. The results of the study can be used in the field of the criminal law cycle. The practical significance lies in the possibility of introducing the results of the research into the educational process in the presentation of the discipline “The method of investigation of crimes”, special courses, as well as in raising the skills of practical police officers. As a result of the study, conclusions were drawn in the form of concrete proposals for addressing typical problems arising in the investigation of street fraud.Анализ следственно-оперативной практики свидетельствует о многочисленных трудностях доказывания в ходе досудебного расследования действий мошенников в силу различных факторов. На современном этапе много нерешённых вопросов возникает при расследовании наиболее распространённой группы мошенничеств, а именно уличной формы этого преступления. В исследовании поставлена цель освещения наиболее распространённых на практике проблем, возникающих на начальном этапе расследования данной группы мошенничеств, и представлены рекомендации относительно их решения.Аналіз слідчо-оперативної практики свідчить про численні труднощі доказування під час досудового розслідування дій шахраїв із-за різних факторів. На сучасному етапі багато невирішених питань постає під час розслідування найбільш поширеної групи шахрайств, а саме вуличної форми цього кримінального правопорушення. У дослідженні поставлено за мету висвітлення найбільш поширених на практиці проблем, що виникають на початковому етапі розслідування даної групи шахрайств, та подано рекомендації щодо їх вирішення

Проблемні питання профорієнтації та професійного відбору кандидатів на службу в органи Національної поліції України

The author of the article has presented the results of the analysis of national approaches to the implementation of vocational guidance work among young people for the selection of police specialties. On this basis the author has singled out problematic issues in each of the vocational guidance areas (professional information, professional counseling, professional selection and professional adaptation). A number of general problems of vocational guidance among young people has been considered. The author has emphasized the general and special shortcomings in the organization and conduction of vocational guidance in regard to professional choice in general and professions related to the service in the units of the National Police of Ukraine, in particular. The general shortcomings include both the peculiarities of the organization of vocational guidance (lack of a unified system of vocational guidance work, insufficient level of interaction between the participants in the process of vocational guidance, lack of an individual, differentiated and phased approach to each individual while implementing professional choice, etc.) and its content component (low level of awareness of children, parents and teachers regarding the existing social professional inquiry; improper attention to the motivational component of the profession selection, etc.). The special shortcomings include the following: lack of awareness among young people about the peculiarities of different specialties (an investigator, an employee of operational units, a district police officer, etc.); lack of opportunity to try themselves in different types of law enforcement activities within the framework of interaction, for example, between district police station, educational institution, school and parents; insufficient use of media opportunities to adequately cover various aspects of police activities. The author has emphasized the necessity of creating an effective strategy of vocational guidance and qualitative selection procedure, referral and enrollment of young people to higher educational institutions with specific learning conditions.Представлены результаты анализа общегосударственных подходов к осуществлению профориентационной работы среди молодёжи для выбора полицейских специальностей, на этой основе выделены проблемные вопросы на каждом из профориентационных направлений (профинформация, профконсультация, профотбор и профадаптация). Сделан акцент на наличии общих и специальных недостатков в организации и проведении профориентационных мероприятий по профессиональному выбору вообще и профессий, связанных со служением в различных подразделениях Национальной полиции Украины, в частности.Представлено результати аналізу загальнодержавних підходів до здійснення профорієнтаційної роботи серед молоді для вибору поліцейських спеціальностей, на цій основі виокремлено проблемні питання на кожному із профорієнтаційних напрямків (профінформація, профконсультація, профвідбір та профадаптація).
