제주자치경찰단의 시사점을 중심으로

학위논문(석사)--서울대학교 대학원 :행정대학원 행정학과(정책학전공),2020. 2. 김순은.This study derived from the Jeju Local Police Agency's implications of securing political neutrality. Qualitative research was conducted as an analysis method for such research, and in-depth interviews were conducted with 16 local police officers belonging to the Jeju Local Police Agency to collect data. In the pre-research review for analysis, the political neutrality of the police, the introduction plan of the local police system, and the theory of checks and balances were reviewed. The reasons why political neutrality should be kept more strictly within the police organization and the current system for securing political neutrality in the national police have been identified. It also reviewed the introduction plan of the local police system and its model, and the principle of checks and balances and the system of separation of powers among various agencies. After this review, the study set up in-depth interview questions for the Jeju Local Police Agency. The questions were written in four sections: human factors, institutional factors, cultural factors, and external environmental factors. As for human factors, questions were drawn up concerning the governors' personnel dictatorialness, the desire of local police officers to power, abuse of appointees' authority over personnel affairs, and political power from specific origin. As for institutional factors, questions were drawn up concerning checks and balances through separation of powers, interference by other administrative agencies and practical functions of The Public Order Administration Committee. As for cultural factors, questions were written about authoritarian culture and associative culture, and questions about external environmental factors were drawn up concerning personnel intervention by political circles. As a result of the in-depth interview, in personnel factors, there was no means to check the exclusive power of the governor, and the provincial assembly, the personnel committee and the audit committee were checking the head of the local police agency. About the abuse of appointees' authority over personnel affairs, most people thought that the personnel is conducted objectively by the personnel committee, which consisted of external and internal members, but there was a case in which the irregularity was found. In addition, the Jeju Local Police Agency had no case of a certain origin monopolizing a major position, as special employment only existed on a single path to foreign language specialties. In institutional factors, an independent power check agency does not exist from the governor, the Jeju Local Police Agency received interference from the province in the organizational and budget sectors, and the Public Order Administration Committee has became nominal that does not function in pracitce. In cultural factors, the police officers said that although much weakend, there still exists a stronger authoritarian culture than other institutions, and that the culture of association for promotion and personnel is prevalent. Lastly, in external environmental factors, the organization was so small that it seemed to feel that there was no intervention in personnel affairs from the political circles, except for the head of the local police agency. Based on these implications, for expanding the implementation of the local police system all over the country, first of all, a local police personnel committee should be set up. Second, the audit committee should be set up and the term system for the head of the local police agency must be introduced. Third, the promotion opening should be set up according to one's background. Fourth, the city and province police committee independent from mayor and governor should be established. Fifth, it was suggested that the local police agency should stipulate the regulations for cooperation with local governments and promote cultural harmony.본 연구는 자치경찰의 정치적 중립 확보 방안을 제주 자치경찰단의 시사점으로부터 도출하였다. 이러한 연구를 위한 분석 방법으로 질적 연구를 실시하였으며, 자료 수집을 위해 제주 자치경찰단 소속의 자치경찰관 16명을 대상으로 심층 면담을 실시하였다. 분석을 위한 선행 연구 검토에서는 경찰의 정치적 중립성, 자치경찰제의 도입 방안, 그리고 견제와 균형에 관한 이론에 대해 검토하였다. 경찰 조직 내에서 정치적 중립성이 더 엄격하게 지켜져야 하는 이유와 현재 국가경찰에서 정치적 중립성을 확보하기 위한 제도를 파악하였다. 또한 자치경찰제의 도입 방안과 그 모형, 그리고 견제와 균형의 원리와 여러 기관 간의 권력 분립 제도에 대해 검토하였다. 이러한 검토 후에 본 연구에서는 제주 자치경찰단에 대한 심층 면담 질문을 설정하였다. 질문은 인적 요인, 제도적 요인, 문화적 요인, 외부 환경적 요인 등 4가지로 나누어 작성하였다. 인적 요인에 대해서는 도지사의 인사 전횡, 자치경찰관의 권력욕, 임명권자의 인사권 남용, 특정 출신의 정치적 파워에 관한 질문을 작성하였다. 제도적 요인에 대해서는 권력 분립을 통한 견제와 균형, 타 행정기관의 간섭, 치안행정위원회의 실질적 기능에 대한 질문을 작성하였다. 문화적 요인에 대해서는 권위주의 문화와 연줄주의 문화에 대한 질문을 작성하고, 외부 환경적 요인에 대해서는 정치권의 인사 개입에 대한 질문을 작성하였다. 심층 면담의 결과 인사 요인에서 도지사의 독점적 권력에 대한 견제 수단이 없고, 자치경찰단장에 대해서는 도의회·인사위원회·감사위원회 등이 견제를 하고 있었다. 임명권자의 인사권 남용에 대해서는 인사위원회가 외부위원 및 내부위원으로 구성되어 객관적으로 인사가 행하여지고 있다고 대부분 생각하였으나, 실제로는 부정인사가 적발된 사례가 있었다. 또한 제주 자치경찰단에는 특채가 외국어 특채 단일 경로밖에 존재하지 않아, 특정 출신이 주요 보직을 독점하는 경우는 없었다. 제도적 요인에서는 도지사로부터 독립된 권력 견제 장치가 존재하지 않고, 조직·예산 부분에서 도의 간섭을 받으며, 치안행정위원회는 실질적 기능을 하지 못하는 유명무실한 기관이 되었다. 문화적 요인에서는 많이 유화되었지만 여전히 타 기관보다는 강한 권위주의 문화가 존재하고, 승진 및 보직 인사에 대한 연줄주의 문화가 팽배하다고 하였다. 마지막으로 외부 환경적 요인에 대해서는 조직의 규모가 매우 작기 때문에 자치경찰단장을 제외한 경찰관에 대해서는 정치권의 인사 개입이 없다고 느끼는 것으로 보였다. 이러한 시사점을 바탕으로 자치경찰제를 전국 시행 확대함에 있어서 첫째, 자치경찰 인사위원회를 설치할 것. 둘째, 감사위원회를 설치하고 자치경찰단장 임기제를 도입할 것. 셋째, 출신에 따른 승진 티오를 설정할 것. 넷째, 시·도지사로부터 독립된 시·도 경찰위원회를 설치할 것. 다섯째, 지자체와의 협업 규정을 명문화하고 문화적 융화를 도모할 것을 제시하였다.제 1 장 서론 1 제 1 절 연구목적 및 필요성 1 제 2 절 자치경찰제 모형 3 제 2 장 이론적 논의와 선행연구 검토 6 제 1 절 정치적 중립의 의의 6 제 2 절 자치경찰제의 논의 7 제 3 절 자치경찰제에서 정치적 중립의 중요성 8 제 4 절 견제와 균형에 관한 이론적 논의 9 제 3 장 연구방법 12 제 1 절 연구방법 12 제 2 절 연구 참여자의 특성 13 제 3 절 분석의 틀 14 제 4 장 연구결과 및 분석 17 제 1 절 인적요인 17 1. 도지사의 인사 전횡 17 2. 자치경찰관의 권력욕 19 3. 임명권자의 인사권 남용 22 4. 특정 출신의 정치적 파워 25 제 2 절 제도적 요인 28 1. 권력 분립을 통한 견제와 균형 28 2. 타 행정기관의 간섭 30 3. 유명무실한 치안행정위원회 32 제 3 절 문화적 요인 35 1. 권위주의 문화 35 2. 연줄주의 문화 37 제 4 절 외부환경적 요인 40 1. 정치권의 인사 개입 40 제 5 장 정책적 제언 43 제 1 절 자치경찰 인사위원회 설치 43 제 2 절 감사위원회의 설치와 자치경찰단장 임기제 도입 44 제 3 절 출신에 따른 승진 티오 설정 45 제 4 절 시·도 경찰위원회 설치 46 제 5 절 협업 규정의 명문화와 문화적 융화 46 제 6 장 결론 48 참고문헌 51 Abstract 53Maste
