EXECUTIVE ORDER NO. 2000-26
WHEREAS, the State of South Carolina is committed to providing community-based alternatives for persons
with physical, mental, or developmental disabilities and recognizes that such services advance the best
interest of all South Carolinians; and
WHEREAS, South Carolina is committed to providing community-based services that effectively foster
independence and acceptance of persons with physical, mental, or developmental disabilities; and
WHEREAS, programs such as home and community-based services provide the opportunity for persons with
physical, mental, or developmental disabilities to live productive lives in their own communities; and
WHEREAS, as Governor of the State of South Carolina, I am committed to ensuring access to care and the
provision of services to persons with physical, mental, or developmental disabilities in accordance with the
Americans with Disabilities Act; and
WHEREAS, South Carolina must build upon its many successes and undertake a broader review of our
programs for persons with physical, mental, or developmental disabilities and ensure services are offered in
the most appropriate setting.
NOW, THEREFORE, I do hereby establish the South Carolina Home and Community-Based Services Task
Force. The objective of the Task Force shall be to develop a comprehensive, effective, working plan as
recommended by the United States Supreme Court in its recent decision in Olmstead v. LC., 119 S.Ct. 2176
(1999). The Task Force shall.
Conduct a comprehensive review of all services and support systems available to persons with physical,
mental, or developmental disabilities in South Carolina. This review shall analyze the availability,
application, and efficacy of existing community-based alternatives for persons with physical, mental, or
developmental disabilities. The review shall focus on identifying affected populations, improving the
flow of information about support services in the community, and removing barriers that impede
opportunities for community inclusion.

The Task Force shall ensure the involvement of consumers, parents of consumers, advocates, providers
and relevant agency representatives in developing the plan.
2.
Submit a comprehensive written report of its findings to the Governor no later than June 29, 2001. The
report will include specific recommendations on how South Carolina can improve its services for
persons with physical, mental, or developmental disabilities by legislative, administrative, or agency
action.
3.
The plan shall contain a timeline for implementation.4.
All affected agencies and other public entities shall cooperate fully with the Task Force research,
analysis and production of the report.
5.
The South Carolina Developmental Disabilities Council shall provide staff support as necessary to assist
the Task Force in carrying out the directives of this Executive Order.
6.

EXECUTIVE ORDER NO. 2001-10
WHEREAS, in Executive Order 2000-29, I established the Advisory Campaign Reform Study Commission and
charged it with the responsibility of providing me with a final report and recommendation by April 16, 2001; and
WHEREAS, the Commission should have a full opportunity to evaluate the options available to our State in
addressing the efforts to reform and improve South Carolina's election laws; and
WHEREAS, the Commission Chairman has indicated to me that the Commission needs a brief additional time period
to complete the preparation of its report and recommendation.
NOW, THEREFORE, I hereby extend the time for the Commission to provide me with a final report from April 16,
2001 to April 25, 2001.
This Order shall take effect immediately.

EXECUTIVE ORDER NO. 2001-20
WHEREAS, on June 28, 2001, I issued Executive Order 2001-16, which ordered that an election be held for Seat 1 of
Bamberg County School District 2; and
WHEREAS, I set the date of that election for August 14, 2001, or such date as is approved by the United States
Department of Justice; and
WHEREAS, I ordered that the election be conducted by the Bamberg County Board of Registration and Election
Commission; and
WHEREAS, the United States Department of Justice has requested more information before making a decision on
whether to preclear the election; and
WHEREAS, the United States Department of Justice must preclear the election before it can be held; and
WHEREAS, the United States Department of Justice has requested that I set a new date for the election.
NOW, THEREFORE, I hereby amend Executive Order 2001-16 to set the date for the above-referenced election on
October 9, 2001, or at such earliest possible date after October 9, 2001, that is precleared by the United States
Department of Justice.

Executive order no. 2001-20

This executive order for Governor Jim Hodges orders that the sales tax and bond issue election for the Jasper County School District be held

EXECUTIVE ORDER NO. 2002-36
WHEREAS, pursuant to resolutions of the Board of Education of the Jasper County School District dated
September 18, 2002, and the Jasper County Election and Registration Commission dated October 3, 2002, a
referendum for a sales tax and bond issue was scheduled to be held on December 7, 2002; and
WHEREAS, because of notice publication and absentee ballot preparation failures, the Jasper County
Election and Registration Commission, the competent election authority, has declared that it is unable to
conduct the referendum on December 7, 2002 as scheduled; and
WHEREAS, the Jasper County School District and the Jasper County Election and Registration Commission
have requested a new referendum election date pursuant to Section 7-13-1170 of the South Carolina Code of
Laws; and
WHEREAS, Section 7-13-1170 of the South Carolina Code of Laws (1976), as amended, provides "when
any election official of any political subdivision of this State charged with ordering, providing for, or holding
an election has neglected, failed, or refused to order, provide for, or hold the election at the time appointed, or
if for any reason the election is declared void by competent authority, and these facts are made to appear to
the satisfaction of the Governor, he shall, should the law not otherwise provide for this contingency, order an
election or a new election to be held at the time and place, and upon the notice being given which to him
appears adequate to ensure the will of the electorate being fairly expressed. To that end, he may designate the
existing election official or other person as he may appoint to perform the necessary official duties pertaining
to the election, and to declare the result."
NOW, THEREFORE, pursuant to the authority vested in me by the Constitution and Statutes of the State of
South Carolina, I hereby:
Order that the sales tax and bond issue referendum election for the Jasper County School District
originally scheduled to be held on December 7, 2002, be held instead on February 15, 2003, subject to
preclearance by the United States Department of Justice; and
A.
Designate the Jasper County Election and Registration Commission perform the necessary official
duties pertaining to the election, and to declare the result; and
B.
Direct the Jasper County Election and Registration Commission to take all necessary steps to ensure
that the list of registered voters is as accurate as possible, that the electronic voting system is
programmed appropriately, proper public notice procedures are followed, and that all necessary
measures are taken to provide for absentee voting in connection with the referendum.
C.
This Executive Order shall be effective immediately.
