Expert's statement about the state of the mental health in the polish criminal procedure

Abstract

Niniejsza praca została poświęcona tematyce opinii o stanie zdrowia psychicznego w polskiej procedurze karnej. Charakteryzując wspomniany rodzaj ekspertyzy nie można pominąć ogólnych wymagań stawianych biegłym podczas sporządzania przez nich opinii. W związku z tym w pierwszym rozdziale pracy została ukazana instytucja biegłego sądowego, podkreślono kryteria pozwalające na stwierdzenie prawidłowości sporządzonej opinii, a także wpływ nieprawidłowości zawartych w opiniach na przebieg postępowania karnego. W następnym rozdziale została dokładnie omówiona opinia o stanie zdrowia psychicznego, podkreślono znaczenie biegłego psychiatry w jej sporządzaniu, a także przedmiot i zakres ekspertyzy psychiatrycznej. Ponadto ukazano wpływ ekspertyzy psychiatrycznej na rozstrzygnięcia podejmowane w ramach postępowania karnego. W ostatnim rozdziale ukazano wpływ biegłego psychologa na kształtowanie opinii o stanie zdrowia psychicznego, podkreślono tendencję do sporządzania opinii kompleksowych przez biegłych psychiatrów i psychologów, a także seksuologów w przypadku wystąpienia zaburzeń preferencji seksualnych.This master thesis refers to the issue of the expert’s statement about the state of the mental health in the polish criminal procedure. Describing this type of expertise, it is not possible to ignore general requirements which are being put for the experts - that’s why in the first chapter of the work was presented the institution of the expert witness. This chapter contains criteria which allows to state about the correctness of the expert’s statement, as well as the influence of irregularities in statements on the course of criminal proceedings. In the next chapter was presented the issue of the expert’s statement about the state of the mental health - the importance of the psychiatrist expert statement, subject and the scope of psychiatrist statement. Moreover an influence of the psychiatric expert opinion was portrayed for decisions taken as part of criminal proceedings. In the last chapter was presented the influence of the expert psychologist on the forming of the statement abut the state of the mental health. In this chapter was underlined a tendency of drafting comprehensive statements by expert psychiatrists, psychologists, as well as sexologists - in case of the appearance of disorders of sexual preference
