SIR: I have the honor to transmit herewith for the consideration of Congress copy of a communication from the Commissioner of Indian A:fl'airs of the 11th instant, forwarded by the Secretary of the Interior, in reference to an appropriation of $1,000 to meet an excess of expendi-tures by the Southern Ute Commission under the act of May 1, 1888. SIR: I am in receipt, by your reference of the 27th ultimo, of a com-munication from T. S. Childs, secretary and special disbursing agent of the Southern Ute Commission, in reference to a deficiency in the sum of $1,000, needed to meet an excess of expenditure by the Southern Ute Commission, in carrying out the provisions of the act of Congress, ap-proved May 1, 1888 (25 Stat., 133), and incurred by the Commission in the prosecution of its duties. · 2 SOUTHERN UTE COMMISSION. The former estimate for this amount was submitted for the action of the Congress by the Department on the 26th of February, 1889, without a recommendation from this office, but it is a fact that a liability in the amount named has been incurred by the said Commission, and this office recommends that the former estimate be renewed in the sum named, or so much thereof as may be necessary, to cover deficiencies in expenditures incurred in carrying out the provisions of said act, under title of appropriation "Commission to negotiate with Utes of Southern Colorado." Sm: I submit a recommendation of your predecessor for an appropriation. by Con-gress of $1,000, or so much of this amount as may be needed, to meet an excess of ex-penditures by the Southern Ute Commission. The circumstances have been fully ex-plained in my correspondence:with the Department. The agreement with the Southern Ute Indians was made within the limits of the appropriation. The commissioners were, · however, ordered to report in Washington. Thi&, by the increased time and expense involved, carried the expenditures beyond the appropriation. An unexpected bill from the War Department increased this excess. Under the circumstances the claim would seem neither unjust nor unreasonable. The communication of the late Secretar.v was made of course to a former Congress. The committees of the present Congress, I understand, will wish its renewal or in-dorsement by yourself. DEPARTMENT OF THE INTERIOR, Washington, February 26, 1889. SIR: The Department is informed by Rev. Thos. S. Childs, member, and the special disbursing agent of the Southern Ute Commission, appointed in accordance with the act of May 1, 1888 (25 Statutes, 133), that an indebtedness amounting to about $1,000 in excess of the sum of $10,000 appropriated by said act of May 1, 1888, has been in-curred by the Commission in the prosecution ot its duties. The work accomplished by this Commission is fully shown by the papers embodied in Senate Ex. Doc. ()7, Fiftieth Congress, 13econd session, and the full expenses neces-sarily incurred by the Commission should be paid, and I therefore have the honor to request that an item appropriating a sum not exceeding $1,000, or so much thereof as SOUTHERN UTE COMMISSION. 3 may be necessary to complete the settlement of the expenses of said Commission, may be included in the Indian appropriation bill now pending before Congress, to be im-mediately available.
