La ineficacia constitucional para la protección de los derechos

Abstract

Estamos asistiendo en los últimos tiempos a un proceso de vulneración sistemática de los derechos, en especial de los derechos sociales. Por ello cabe preguntarse si la Constitución, sus operadores jurídicos y el marco emanado de esta son las herramientas adecuadas para proteger a los ciudadanos ante esta situación. Para ello deberá observarse la exigibilidad que ostentan los derechos sociales, los límites que impiden su vulneración y la actividad de los tribunales como garantes de estos encaminada a su protección.We are attending in recent times to a process of systematic violation of rights, especially of social rights. That is why we must ask ourselves if the constitution, its legal operators and the frame emanated from it are the adequate tools to protect citizens from this situation. Thus, we must observe the obligatory nature social rights hold, the limits that impede their infringement and the activity of tribunals, as their guarantors, that leads to its protection.peerReviewe
