司法裁判的本质是法官将隐含于法律规范中的意义进行释明、得出裁判规范，并将之与具体案件事实进行等置从而得出判决结论的过程。由此而言之，司法裁判的关键构成部分包括事实与规范两个部分。若欲明了司法裁判之过程，首先就必须要理解法官是如何处理法律规范和案件事实的。换言之，司法裁判必定是出穿梭来往于规范与事实之间的。 本报告的目的是从法学方法论、司法裁判理论的角度，展现出法官如何完成事实与规范之间的“眼光往返流转”。本报告以司法裁判中的规范和事实作为重点分析视角，共分两个主要部分。上编是“司法中的规范与解释”，下编是“司法中的事实与判断”。每一编中汇集了近两年来作者已经成型/发表或尚在构思中的主题论文。...The essence of judicial judgment is the process that the judge clarifies the meaning hided in legal norm, concludes adjudication norm, and makes it equally compared to the specified case fact and then draws a judgment conclusion.
