Abstract

随着我国的经济体制改革以及市场机制变革的扎实推进,我国的劳动关系已基本形成为市场化的劳动关系,在劳动关系的影响因素中,不仅仅是市场的调控作用尤为重要,且政府也通过适当的放权在其中起着至关重要的作用。出于完善劳动合同当事人的权益,确保劳动者的权益不受侵害,进而健全劳动保护制度的立法目的,我国相继颁布了《中华人民共和国劳动法》、《就业促进法》等一系列法律法规来完善符合我国国情的劳动关系。 我国于2008年1月1日开始实施《劳动合同法》,它主要涉及了劳动合同签订、履行与解除和经济补偿金的支付等等问题。《劳动合同法》的颁布与实施加大了对劳动者的保护力度,使得劳动者权益的保障有法可依。本文采用2001...With the reformation of China's economic structure and the progress of market mechanism, China's labor relationship has basically formed a market-oriented labor relationship.
