Medicamentos : ações judiciais contra o município de Catuípe/RS

Abstract

O estudo objetivou analisar as ações judiciais contra a Prefeitura Municipal de Catuípe, para requerer medicamentos, durante os anos de 2009 e 2010. Foram analisados 14 processos, sendo que 10 são do último ano, comprovando o crescimento expressivo das ações. Dos 61 medicamentos solicitados, 64% não são padronizados por listas ou programas do SUS. A fundamentação jurídica em praticamente todos os processos é a mesma, fazendo correspondência entre a Lei Orgânica Municipal, a Constituição Estadual e a Federal, esta em especial com os artigos 196 e 197. A Assessoria Jurídica municipal tem contestado as ações baseada na legitimidade passiva, na solidariedade dos entes públicos e no pedido de extinção do processo, pois são medicamentos fornecidos pela farmácia básica do município. A efetivação do direito a saúde através do Poder Judiciário, sem integração com as políticas públicas, provoca repercussões na Assistência Farmacêutica e dificulta a alocação dos recursos. É preciso haver comunicação entre o Poder Judiciário e Executivo a fim de garantir o direito do cidadão à assistência terapêutica integral, com medicamentos eficazes e seguros, mas sem causar prejuízos à equidade do sistema público de saúde.The objective of the study was to analyze the judicial cases against the Municipal County of Catuípe in order to require medications in the years of 2009 and 2010. Fourteen cases were analyzed, ten being in the last year, proving the growing of cases. Of the sixty-one solicited medications, 64% were not patronized by SUS lists or programs. The judicial fundament in practically all of the cases is the same, making correspondence between the Municipal Organic Law, State and Federal Constitution, especially in the articles 196 and 197. The municipal judicial assessor has questioned cases based in the passive legitimacy in the public entities’ solidarity and in the request of extinction of the process because they are medications provided by the municipal basic pharmacy. The effectuation of the right to health through the Judicial Branch, without integration of public politics causing repercussions in the Pharmaceutical Assistance and making it difficult to allocate resources. There’s a need to have a communication among the Judicial and Executive Branch in order to guarantee the citizen’s right to integral therapeutic assistance, with efficient and safe medications but without causing impairment to the public health system entity
