CONTRIBUTION TO THE CONSTITUTION OF SUSTAINABLE BOSNIA AND HERZEGOVINA IN THE FUNCTION OF ACHIEVEING COMPLETE EQUALITY OF THREE CONSTITUENT PEOPLES CROATS, SERBS AND BOSNIAKS

Abstract

Nužnost popravka Ustava u Bosni i Hercegovini, s posebnim naglaskom na nametnute promjene od predstavnika međunarodne zajednice, prepoznaje se kao problem općeg funkcioniranja vlasti, kako zakonodavne tako i izvršne i pravosudne. Nekoliko odluka Ustavnog suda BiH jasno usmjerava sljedeće nužne korake u popravcima zakonodavstva, kako bi sustav funkcionirao. Predvorje europskih integracija i institucionalno priključenje BiH istim kao imperativ je nametnulo racionalnost u organiziranju. Funkcionalnija organizacijska struktura BiH u osnovi mora počivati na zapisanoj ustavnoj jednakopravnosti hrvatskog, srpskog i bošnjačkog naroda na cijelom području BiH, vrlo jasnog stava da Federacija BiH jest federacija konstitutivnih naroda, a ne županija. Načela konstitutivnosti i legitimnog predstavljanja konstitutivnih naroda na svim administrativnim razinama vlasti do kraja su ugrađena u temelje modela europske BiH koji nudimo. Moderna, europski orijentirana, racionalna u organizaciji i učinkovita u djelovanju ponuđena organizacijska struktura nudi osnovu na kojoj sva tri konstitutivna naroda i svi građani mogu prepoznati svoju budućnost.The necessity of revising the Constitution of Bosnia and Herzegovina, with particular emphasis on imposed changes by representatives of international community, is recognized as a problem of general government functioning, both legislative and executive, and judicial. Several decisions of the Constitutional Court of BiH clearly point out the next steps necessary in the revision of the legislation, to make the system work. Proximity of the European integration and institutional accession of Bosnia and Herzegovina into them, has imposed, as an imperative, rationality concerning the organization. The more functional organizational structure of BiH must, in its essence, be based on the written constitutional equality of the Croat, Serb and Bosniak peoples on the entire territory of BiH, with a very clear position that the Federation of BiH is a federation of constituent peoples rather than cantons. The principles of constituency and the legitimate representation of constituent peoples on all administrative levels of government are fully incorporated into the bases of the European model which we offer. Modern, European-oriented, rationally organized and effective in acting, this offered organizational structure offers the basis on which all three constituent peoples and all citizens can recognize their future
