En los últimos años son numerosos e intensos los debates que se han mantenido a nivel internacional, tanto
desde un punto de vista moral como jurídico, en relación
a la idea de que la incapacidad de controlar la agresividad
impulsiva puede estar parcialmente influenciada por el perf
il genético de un determinado individuo. Así, son numerosas
las sentencias en el marco internacional, que han permitido mitigar la pena de los acusados, constituyéndose éstas como
hechos altamente relevantes en el sistema penal y colocand
o a la genética comportamental en el centro de una fuerte
polémica dadas las implicaciones y las consecuencias que puede
tener tanto en los sistemas judiciales como en la
sociedad desde un punto de vista ético. Con estas sentencias como punto de partida, esta revisión trata de recoger y
exponer todos aquellos genes que podrían asimilarse a este tipo
de sentencias y se debate qué enfoque podría recibir por
parte del sistema judicial español.In recent years numerous and intens
e discussions have been held internationally, both from a moral and a
legal point of view, regarding the idea that the inability to control impulsive behavior and aggressiveness may be partly
influenced by the genetic pattern of a particular individual.
Thus, numerous judgments of several international Courts of
justice, have mitigated the punishment of the defendant, constituting them as highly significant events in the penal
system and placing behavioral genetics at the center of a seve
re controversy, given the implications and consequences
which can have both in judicial systems and in society from
an ethical point of
view. On the basis of
these court rulings,
this review aims to collect and expose all the genes that could be assimilated to such verdicts, as well as a discussion of
the different approaches that could be tackled from th
e Spanish judicial system in relation to this issue
