La protección de la igualdad material se ha logrado en los Estados Unidos mediante las denominadas acciones afirmativas (affirmative actions), instrumentos desarrollados por la jurisprudencia de la Corte Suprema de Justicia de ese país. Estos programas han sido empleados por la Corte Constitucional colombiana, en referencia a la jurisprudencia de los Estados Unidos, como medios idóneos para garantizar la protección de la igualdad material como un derecho fundamental. Esta situación se analiza en el presente artículo como un efecto de la globalización en el área del Derecho. Para desarrollar esta investigación, se adoptó una metodología teórico-analítica, tomando como objeto de estudio las sentencias hito (landmark cases) de la Corte Suprema de Justicia de los Estados Unidos; luego se comparó con la jurisprudencia de la Corte Constitucional colombiana emitida durante los años 2006, 2007 y 2008 respecto a la protección de la igualdad material como un derecho fundamental.The protection of the material equality has been achieved in the United States by using affirmative actions; instruments created by the jurisprudence of the Supreme Court of Justice of that country. These programs have been used by the Colombian Constitutional Court, in reference to the jurisprudence of the United States, as ideal means to guarantee the protection of the material equality as a fundamental right. This situation is analyzed in the present article as a consequence of the globalization of the Law. In order for this investigation to take place, it was used a theoretical-analytic methodology, taking as object of study the landmark cases of the Supreme Court of the United States; then they were compared to the jurisprudence of the Colombian Constitutional Court issued during years 2006, 2007 and 2008 in regard to the protection of the material equality as a fundamental right
